Chapter 41: Conditions in marriage
باب الشَّرْطِ فِي النِّكَاحِ
Sunan Ibn Majah 1955
It was narrated from 'Amr bin Shu'aib, from his father, that his grandfather said
“The Messenger of Allah (ﷺ) said: “Whatever is given as a dowry or gift before the marriage, it belongs to her. Whatever is given after the marriage belongs to the one to whom it was given. And the most deserving matter for which a man is honored is (the marriage of) his daughter or sister.”حَدَّثَنَا أَبُو كُرَيْبٍ، حَدَّثَنَا أَبُو خَالِدٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، قَالَ قَالَ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ " مَا كَانَ مِنْ صَدَاقٍ أَوْ حِبَاءٍ أَوْ هِبَةٍ قَبْلَ عِصْمَةِ النِّكَاحِ فَهُوَ لَهَا وَمَا كَانَ بَعْدَ عِصْمَةِ النِّكَاحِ فَهُوَ لِمَنْ أُعْطِيَهُ أَوْ حُبِيَ وَأَحَقُّ مَا يُكْرَمُ الرَّجُلُ بِهِ ابْنَتُهُ أَوْ أُخْتُهُ " .
Chapter 45: Marriage of a Muhrim
باب الْمُحْرِمِ يَتَزَوَّجُ

It was narrated from Ibn 'Abbas that
the Prophet (ﷺ) got married while he was a Muhrim (in Ihram).حَدَّثَنَا أَبُو بَكْرِ بْنُ خَلاَّدٍ الْبَاهِلِيُّ، حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ جَابِرِ بْنِ زَيْدٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ النَّبِيَّ ـ صلى الله عليه وسلم ـ نَكَحَ وَهُوَ مُحْرِمٌ .
