Mishkat al-Masabih 35

Anas said

God’s messenger seldom addressed us without saying, “He who is not trustworthy has no faith, and he who does not keep his covenant has no religion." Baihaqi transmitted it in Shu'ab al-lman.

وَعَنْ أَنَسٍ رَضِيَ اللَّهُ عَنْهُ قَالَ: قَلَّمَا خَطَبَنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِلَّا قَالَ: «لَا إِيمَانَ لِمَنْ لَا أَمَانَةَ لَهُ وَلَا دِينَ لِمَنْ لَا عَهْدَ لَهُ» . رَوَاهُ الْبَيْهَقِيُّ فِي شُعَبِ الْإِيمَانِ

‘Amr b. Shu'aib, on his father’s authority, said his grandfather told that God’s Messenger was fixing the blood wit for accidental death at the rate of four hundred dinars or their equivalent in silver for townsmen, and he was fixing it according to the price of camels, so when they were dear he increased the amount to be paid and when cheap prices prevailed he reduced the amount to be paid. In the time of God’s Messenger they reached between four hundred and eight hundred dinars, their equivalent in silver being eight thousand dirhams. He said that God's Messenger gave judgment that those who possessed cattle should pay two hundred cows, and those who possessed sheep two thousand sheep. He said that blood wit was to be treated as something to be inherited by the heirs of the one who was killed, and he gave judgment that the blood wit for a woman should be divided among her relatives on her father’s side, but the killer should not inherit anything. Abu Dawud and Nasa’i transmitted it.

وَعَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ: كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يُقَوِّمُ دِيَةَ الْخَطَأِ عَلَى أَهْلِ الْقُرَى أَرْبَعَمِائَةِ دِينَارٍ أَوْ عِدْلَهَا مِنَ الْوَرِقِ وَيُقَوِّمُهَا عَلَى أَثْمَانِ الْإِبِلِ فَإِذَا غَلَتْ رَفَعَ فِي قيمتِها وإِذا هاجَتْ رُخصٌ نَقَصَ مِنْ قِيمَتِهَا وَبَلَغَتْ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَا بَيْنَ أَرْبَعِمِائَةِ دِينَارٍ إِلَى ثَمَانِمِائَةِ دِينَارٍ وَعِدْلُهَا مِنَ الْوَرِقِ ثَمَانِيَةُ آلَافِ دِرْهَمٍ قَالَ: وَقَضَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى أَهْلِ الْبَقَرِ مِائَتَيْ بَقَرَةٍ وَعَلَى أَهْلِ الشَّاءِ أَلْفَيْ شَاةٍ وَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «إِنَّ الْعَقْلَ مِيرَاثٌ بَيْنَ وَرَثَةِ الْقَتِيلِ» وَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ عَقْلَ الْمَرْأَةِ بَيْنَ عَصَبَتِهَا وَلَا يَرِثُ القاتلُ شَيْئا. رَوَاهُ أَبُو دَاوُد وَالنَّسَائِيّ

Mishkat al-Masabih 3501

He said, on his father’s authority, that his grandfather reported the Prophet (ﷺ) as saying, “Blood wit for what resembles intentional murder is to be made as severe as that for intentional murder, but the Culprit is not to be killed.” Abu Dawud transmitted it.

وَعَنْهُ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «عَقْلُ شِبْهِ الْعَمْدِ مُغَلَّظٌ مِثْلُ عَقْلِ الْعَمْدِ وَلَا يُقْتَلُ صاحبُه» . رَوَاهُ أَبُو دَاوُد

Mishkat al-Masabih 3502

He said, on his father’s authority, that his grandfather told that God’s Messenger gave judgment that a third of the blood wit should be paid for loss of eyesight when the eye is not removed. Abu Dawud and Nasa’i transmitted it.

وَعَنْهُ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ: قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الْعَيْنِ الْقَائِمَةِ السَّادَّةِ لِمَكَانِهَا بِثُلْثِ الدِّيَةِ. رَوَاهُ أَبُو دَاوُد وَالنَّسَائِيّ

Muhammad b. ‘Amr, on the authority of Abu Salama, said Abu Huraira told that God’s Messenger gave judgment that a male or female slave of the best quality, or a horse, or a mule should be paid for a miscarriage. Abu Dawud transmitted it, saying this tradition is transmitted by Hammad b. Salama and Khalid al-Wasiti on the authority of Muhammad b. ‘Amr, but he did not mention “or a horse or a mule.”

وَعَنْ مُحَمَّدِ بْنِ عَمْرٍو عَنْ أَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ قَالَ: قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الجَنينِ بغُرَّةٍ: عَبْدٍ أَوْ أَمَةٍ أَوْ فَرَسٍ أَوْ بَغْلٍ. رَوَاهُ أَبُو دَاوُدَ وَقَالَ: رَوَى هَذَا الْحَدِيثَ حَمَّادُ بْنُ سَلَمَةَ وَخَالِدٌ الْوَاسِطِيُّ عَنْ مُحَمَّدِ بْنِ عَمْرٍو وَلَمْ يَذْكُرْ: أَوْ فَرَسٍ أَوْ بغل

‘Amr b. Shu'aib, on his father’s authority, said his grandfather reported God’s Messenger as saying, “Anyone who practices medicine when he is not known as a practitioner will be held responsible.”* Abu Dawud and Nasa’i transmitted it. *He will have to pay blood wit if the patient dies.

وَعَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «من تطيب وَلَمْ يُعْلَمْ مِنْهُ طِبٌّ فَهُوَ ضَامِنٌ» . رَوَاهُ أَبُو دَاوُد وَالنَّسَائِيّ

‘Imran b. Husain told that when the slave of some poor people cut off the ear of a slave of some rich people, and his people came to the Prophet (ﷺ) telling him that they were poor, he imposed no compensation on them. Abu Dawud and Nasa’i transmitted it.

وَعَن عِمْران بن حُصَينٍ: أَنَّ غُلَامًا لِأُنَاسٍ فُقَرَاءَ قَطَعَ أُذُنَ غُلَامٍ لِأُنَاسٍ أَغْنِيَاءَ فَأَتَى أَهْلُهُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالُوا: إِنَّا أُنَاسٌ فُقَرَاءُ فَلَمْ يَجْعَلْ عَلَيْهِمْ شَيْئًا. رَوَاهُ أَبُو دَاوُدَ وَالنَّسَائِيُّ

Mishkat al-Masabih 3593

Rafi‘ b. Khadij reported the Prophet (ﷺ) as saying, “The hand is not to be cut off for taking fruit or the pith of the palm-tree.” Malik, Tirmidhi, Abu Dawud, Nasa'i, Darimi and Ibn Majah transmitted it.

عَنْ رَافِعِ بْنِ خَدِيجٍ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ» رَوَاهُ مَالِكٌ وَالتِّرْمِذِيُّ وَأَبُو دَاوُدَ وَالنَّسَائِيُّ وَالدَّارِمِيُّ وَابْنُ مَاجَهْ

‘Amr b. Shu'aib, on his father’s authority, said his grandfather, ‘Abdallah b. ‘Amr b. al-‘As, told that God’s Messenger was asked about fruit which was hung up and said, “If anyone steals any of it after it is put in the place where it is dried and it amounts to the price of a shield, he must have his hand cut off.” Abu Dawud and Nasa’i transmitted it.

وَعَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَبْدِ اللَّهِ بْنِ عَمْرٍو بْنِ الْعَاصِ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: أَنَّهُ سُئِلَ عَنِ الثَّمَرِ الْمُعَلَّقِ قَالَ: «مَنْ سَرَقَ مِنْهُ شَيْئًا بَعْدَ أَنْ يُؤْوِيَهُ الْجَرِينَ فَبَلَغَ ثَمَنَ الْمِجَنِّ فَعَلَيْهِ الْقَطْعُ» . رَوَاهُ أَبُو دَاوُد وَالنَّسَائِيّ

Mishkat al-Masabih 3595

‘Abdallah b. ‘Abd ar-Rahman b. Abu Husain al-Makki reported God’s Messenger as saying, “A hand is not to be cut off for fruit which is hung up, or for a sheep stolen by night from the mountain;* but when the sheep is in its fold or the fruit in the place where it is dried a hand is to be cut off for whatever reaches the price of a shield.” Malik transmitted it. * Harisa jabal. It is used either of a sheep or goat stolen before it gets back from the mountain to the fold, or of one guarded in the mountain. The most satisfactory reason for the prescription would seem to be that animals kept in the mountain are not sufficiently protected.

وَعَنْ عَبْدِ اللَّهِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ أَبِي حُسَيْنٍ الْمَكِّيِّ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لَا قَطْعَ فِي ثَمَرٍ معلَّقٍ وَلَا فِي حَرِيسَةِ جَبَلٍ فَإِذَا آوَاهُ الْمُرَاحُ وَالْجَرِينُ فَالْقَطْعُ قيمًا بلغ ثمن الْمِجَن» . رَوَاهُ مَالك

Jabir reported God’s Messenger as saying, "Cutting off the hand is not to be inflicted on one who plunders, but he who does so conspicuously does not belong to us.” Abu Dawud transmitted it.

وَعَنْ جَابِرٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لَيْسَ عَلَى الْمُنْتَهِبِ قَطْعٌ وَمَنِ انْتَهَبَ نُهْبَةً مَشْهُورَةً فَلَيْسَ مِنَّا» . رَوَاهُ أَبُو دَاوُد

Mishkat al-Masabih 3597

He reported the Prophet (ﷺ) as saying, “Cutting off the hand is not to be inflicted on one who is treacherous, one who plunders, or one who snatches something.” Tirmidhi, Nasa’i, Ibn Majah and Darimi transmitted it.

وَعَنْهُ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لَيْسَ عَلَى خَائِنٍ وَلَا مُنْتَهِبٍ وَلَا مُخْتَلِسٍ قَطْعٌ» . رَوَاهُ التِّرْمِذِيُّ وَالنَّسَائِيُّ وَابْنُ مَاجَهْ والدارمي

Mishkat al-Masabih 3598, 3599, 3600

It is transmitted in Sharh as-sunna that Safwan b. Umayya came to Medina and slept in the mosque, using his cloak as a pillow. A thief came and took his cloak and Safwan seized him and brought him to God’s Messenger who ordered that his hand should be cut off. Safwan then said, "This was not my intention. I give it to him as sadaqa.” God’s Messenger replied, "Why did you not do so before bringing him to me?” Ibn Majah transmitted something similar on the authority of ‘Abdallah b. Safwan who quoted his father’s authority, and Darimi did so also on the authority of Ibn ‘Abbas.

وَرُوِيَ فِي «شَرْحِ السُّنَّةِ» : أَنَّ صَفْوَانَ بْنَ أُمَيَّةَ قَدِمَ الْمَدِينَةَ فَنَامَ فِي الْمَسْجِدِ وَتَوَسَّدَ رِدَاءَهُ فَجَاءَ سَارِقٌ وَأَخَذَ رِدَاءَهُ فَأَخَذَهُ صَفْوَانُ فَجَاءَ بِهِ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَمَرَ أَنْ تُقْطَعَ يَدُهُ فَقَالَ صَفْوَانُ: إِنِّي لَمْ أُرِدْ هَذَا هُوَ عَلَيْهِ صَدَقَةٌ. فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «فَهَلا قبل أَن تَأتِينِي بِهِ» وَرَوَى نَحْوَهُ ابْنُ مَاجَهْ عَنْ عَبْدِ اللَّهِ بن صَفْوَان عَن أَبِيه والدارمي عَن ابْن عَبَّاس

Mishkat al-Masabih 350

Ibn Mas'ud reported God’s messenger as saying, “Do not cleanse yourselves with excrement or bones, for that is the provision of your brethren among the jinn.” Tirmidhi transmitted it, as also Nasa'i, but he did not mention “the provision of your brethren among the jinn.”

وَعَنِ ابْنِ مَسْعُودٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لَا تَسْتَنْجُوا بِالرَّوْثِ وَلَا بِالْعِظَامِ فَإِنَّهَا زَادُ إِخْوَانِكُمْ مِنَ الْجِنِّ» . رَوَاهُ التِّرْمِذِيُّ وَالنَّسَائِيُّ إِلَّا أَنَّهُ لَمْ يَذْكُرْ: «إخْوَانكُمْ من الْجِنّ»

Ruwaifi' b. Thabit told that God’s messenger said to him, “You may live for a long time after I am gone, Ruwaifi', so tell people that if anyone ties his beard, or wears round his neck a string to ward off the evil eye, or cleanses himself with animal dung or bone, Muhammad has nothing to do with him. Abu Dawud transmitted it.

وَعَن رويفع بن ثَابت قَالَ: قَالَ لِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: يَا رُوَيْفِعُ لَعَلَّ الْحَيَاةَ سَتَطُولُ بِكَ بَعْدِي فَأَخْبِرِ النَّاسَ أَنَّ مَنْ عَقَدَ لِحْيَتَهُ أَوْ تَقَلَّدَ وَتَرًا أَوِ اسْتَنْجَى بِرَجِيعِ دَابَّة أَو عظم فَإِن مُحَمَّدًا بَرِيء مِنْهُ. رَوَاهُ أَبُو دَاوُد

Abu Huraira reported God’s messenger as saying, “If anyone applies collyrium he should do it an odd number of times. If one does so he has done well, but if not, there is no harm. If anyone cleanses himself with stones he should make use of an odd number. If one does so he has done well, but if not, there is no harm. If anyone eats he should throw away what he removes with a toothpick and swallow what he removes with his tongue. If one does so he has done well, but if not, there is no harm. If one goes to relieve himself he should conceal himself, and if all he can do is to collect a heap of sand he should sit with his back to it, for the devil makes sport with the posteriors of the children of Adam. If one does so he has done well, but if not, there is no harm.” Abu Dawud, Ibn Majah and Darimi transmitted it.

وَعَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «مَنِ اكْتَحَلَ فَلْيُوتِرْ مَنْ فَعَلَ فَقَدْ أَحْسَنَ وَمَنْ لَا فَلَا حَرَجَ وَمَنِ اسْتَجْمَرَ فَلْيُوتِرْ مَنْ فَعَلَ فَقَدْ أَحْسَنَ وَمَنْ لَا فَلَا حرج وَمن أكل فَمَا تخَلّل فليلفظ وَمَا لَاكَ بِلِسَانِهِ فَلْيَبْتَلِعْ مَنْ فَعَلَ فَقَدْ أَحْسَنَ وَمَنْ لَا فَلَا حَرَجَ وَمَنْ أَتَى الْغَائِط فليستتر وَمن لَمْ يَجِدْ إِلَّا أَنْ يَجْمَعَ كَثِيبًا مِنْ رَمْلٍ فَلْيَسْتَدْبِرْهُ فَإِنَّ الشَّيْطَانَ يَلْعَبُ بِمَقَاعِدِ بَنِي آدَمَ مَنْ فَعَلَ فَقَدْ أَحْسَنَ وَمَنْ لَا فَلَا حَرَجَ» . رَوَاهُ أَبُو دَاوُدَ وَابْنُ مَاجَهْ والدارمي

Mishkat al-Masabih 353

'Abdullah b. Mughaffal reported God's messenger as saying, “No one must pass water where he bathes and then wash in it or perform ablution in it, for all evil promptings come from it.” Abu Dawud transmitted it, as did Tirmidhi and Nasa’i, but they did not mention “then wash in it or perform ablution in it”.

وَعَنْ عَبْدِ اللَّهِ بْنِ مُغَفَّلٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لَا يَبُولَنَّ أَحَدُكُمْ فِي مُسْتَحَمِّهِ ثُمَّ يَغْتَسِلُ فِيهِ أَوْ يَتَوَضَّأُ فِيهِ فَإِنَّ عَامَّةَ الْوَسْوَاسِ مِنْهُ» . رَوَاهُ أَبُو دَاوُدَ وَالتِّرْمِذِيُّ وَالنَّسَائِيُّ إِلَّا أَنَّهُمَا لم يذكرَا: «ثمَّ يغْتَسل فِيهِ أويتوضأ فِيهِ»

Mishkat al-Masabih 354

'Abdullah b. Sarjis reported God’s messenger as saying, "None of you must pass water in a [snake's] hole". Abu Dawud and Nasa'i transmitted it.

وَعَن عبد الله بن سرجس قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لَا يَبُولَنَّ أَحَدُكُمْ فِي جُحْرٍ» . رَوَاهُ أَبُو دَاوُد وَالنَّسَائِيّ

Mu'adh reported God's messenger as saying, "Guard against the three things which produce cursing

relieving oneself in watering-places, in the middle of the road, and in the shade.” Abu Dawud and Ibn Majah transmitted it.

وَعَنْ مُعَاذٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: " اتَّقُوا الْمَلَاعِنَ الثَّلَاثَةَ: الْبَرَازَ فِي الْمَوَارِدِ وَقَارِعَةِ الطَّرِيقِ وَالظِّلِّ ". رَوَاهُ أَبُو دَاوُد وَابْن مَاجَه

Abu Sa'id reported God’s messenger as saying, "Two people should not go together to relieve themselves and uncover their private parts and talk, for God is angry with that.” Ahmad, Abu Dawud and Ibn Majah transmitted it.

وَعَنْ أَبِي سَعِيدٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لَا يَخْرُجِ الرَّجُلَانِ يَضْرِبَانِ الْغَائِطَ كَاشِفَيْنِ عَنْ عَوْرَتِهِمَا يَتَحَدَّثَانِ فَإِنَّ اللَّهَ يَمْقُتُ عَلَى ذَلِكَ» . رَوَاهُ أَحْمَدُ وَأَبُو دَاوُدَ وَابْنُ مَاجَهْ

Mishkat al-Masabih 357

Zaid b. Arqam reported God's messenger as saying, "These privies are peopled by jinn and devils, so when one of you goes there he should say, ‘I seek refuge in God from male and female devils.” Abu Dawud and Ibn Majah transmitted it.

وَعَنْ زَيْدِ بْنِ أَرْقَمَ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: " إِنَّ هَذِهِ الْحُشُوشَ مُحْتَضَرَةٌ فَإِذَا أَتَى أَحَدُكُمُ الْخَلَاءَ فَلْيَقُلْ: أَعُوذُ بِاللَّهِ مِنَ الْخُبْثِ والخبائث ". رَوَاهُ أَبُو دَاوُد وَابْن مَاجَه

‘Ali reported God’s messenger as saying, "The covering between the eyes of the jinn and the private parts of the children of Adam when one of them enters the privy is provided by his saying, ‘In the name of God.’” Tirmidhi transmitted it, saying that this is a gharib tradition and that its isnad is not strong.

وَعَنْ عَلِيٍّ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «سَتْرُ مَا بَيْنَ أَعْيُنِ الْجِنِّ وَعَوْرَاتِ بَنِي آدَمَ إِذَا دَخَلَ أَحَدُهُمُ الْخَلَاءَ أَنْ يَقُولَ بِسْمِ اللَّهِ» . رَوَاهُ التِّرْمِذِيُّ وَقَالَ: هَذَا حَدِيثٌ غَرِيبٌ وَإِسْنَاده لَيْسَ بِقَوي

‘A'isha told that when the Prophet (ﷺ) came out from the privy he said, "Grant Thy forgiveness.” Tirmidhi, Ibn Majah and Darimi transmitted it.

وَعَنْ عَائِشَةَ قَالَتْ: كَانَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِذَا خَرَجَ مِنَ الْخَلَاءِ قَالَ «غفرانك» . رَوَاهُ التِّرْمِذِيّ وَابْن مَاجَه والدارمي

‘Ali said that the blood wit for what looked like intentional murder was in three parts

thirty-three she-camels in their fourth year, thirty- three she-camels in their fifth year, and thirty-four she-camels in the sixth year up to the ninth, all pregnant. In a version he said that the blood wit for unintentional murder was in four parts: twenty-five she-camels in their fourth year, twenty-five she-camels in their fifth year, twenty-five she-camels in their third year, and twenty-five she-camels in their second year. Abu Dawud transmitted it.

Mujahid said ‘Umar gave judgment that the blood wit for what resembled intentional murder should be thirty she-camels in their fourth year, thirty she-camels in their fifth year, and forty pregnant she-camels in their sixth year up to the ninth. Abu Dawud transmitted it.

Sa'id b. al-Musayyib said God’s Messenger gave judgment that a male or girl slave of the best quality should be paid for a child which is killed in its mother’s womb. When the one against whom this judgment was given asked, “How should I be fined for one who has not eaten or drunk, or spoken, or raised his voice?” adding that compensation is not to be paid for such, God’s Messenger said, “This man simply belongs to the kahins.”* Malik and Nasa’i transmitted it in mursal form, but Abu Dawud transmitted it on his authority (i.e. Sa'id’s) on the authority of Abu Huraira with a fully connected isnad. * There is a suggestion of rhyme in the Arabic used by the man who asked the question, so he is compared to the kahins who made their utterances in this form.

وَعَن سَعِيدِ بْنِ الْمُسَيَّبِ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى فِي الْجَنِينِ يُقْتَلُ فِي بَطْنِ أُمِّهِ بِغُرَّةِ عَبْدٍ أَوْ وَلِيدَةٍ. فَقَالَ الَّذِي قُضِيَ عليهِ: كيفَ أَغْرَمُ مَنْ لَا شَرِبَ وَلَا أَكَلَ وَلَا نَطَقَ وَلَا اسْتَهَلَّ وَمِثْلُ ذَلِكَ يُطَلُّ. فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «إِنَّمَا هَذَا مِنْ إِخْوَانِ الْكُهَّانِ» . رَوَاهُ مالكٌ وَالنَّسَائِيّ مُرْسلا وَرَوَاهُ أَبُو دَاوُدَ عَنْهُ عَنْ أَبِي هُرَيْرَةَ مُتَّصِلا

Abu Huraira reported God’s Messenger as saying, “No retaliation is payable for a wound caused by a dumb animal, for a mine, or for a well.”* (Bukhari and Muslim.) * A longer form is given on p. 380. The reference is said to be an animal which is not at the time under anyone's charge. No responsibility attaches to anyone who has dug a mine or a well in a place where he is entitled to do so if someone falls in.

عَنْ أَبِي هُرَيْرَةَ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «الْعَجْمَاءُ جَرْحُهَا جُبَارٌ وَالْمَعْدِنُ جُبَارٌ وَالْبِئْرُ جُبَارٌ»

Ya’ la b. Umayya said

I went with God’s Messenger on the expedition of the army of distress,* and I had a hired servant who fought with a man, one of whom bit the other’s hand. The one who was bitten drew away his hand from the mouth of the one who bit him, dislodging his front tooth which fell out. He went to the Prophet, but he imposed no retaliation for his front tooth, saying, ‘Could he be expected to leave his hand in your mouth when you were crunching it like a male camel?” (Bukhari and Muslim.) * This refers to the expedition to Tabuk in 9 A H. Cf. Al-Qur'an, 9:117.

وَعَنْ يَعْلَى بْنِ أُمَيَّةَ قَالَ: غَزَوْتُ مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ جَيْشَ الْعُسْرَةِ وَكَانَ لِي أَجِيرٌ فقاتلَ إِنساناً فعض أَحدهمَا الْآخَرِ فَانْتَزَعَ الْمَعْضُوضُ يَدَهُ مِنْ فِي الْعَاضِّ فَأَنْدَرَ ثَنِيَّتَهُ فَسَقَطَتْ فَانْطَلَقَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَهْدَرَ ثَنِيَّتَهُ وَقَالَ: «أَيَدَعُ يَدَهُ فِي فِيكَ تَقْضِمُهَا كَالْفَحْلِ»

‘Abdallah b. 'Amr told of hearing God’s Messenger say, “He who is killed protecting his property is a martyr.” (Bukhari and Muslim.)

وَعَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو قَالَ: سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: «مَنْ قُتِلَ دُونَ مَالِهِ فَهُوَ شهيدٌ»

Abu Huraira told that a man came and asked God’s Messenger to tell him what he should do if a man came wanting to take his property. He replied, “Do not give him your property.” He asked him to tell him what to do if the man fought with him, and he replied, “Fight with him.” He asked him to tell him what would happen if the man killed him, and he replied, “You will be a martyr.” He asked him to tell him what would happen if he killed the man, and he replied, “He will go to hell.” Muslim transmitted it.

وَعَنْ أَبِي هُرَيْرَةَ قَالَ: جَاءَ رَجُلٌ فَقَالَ: يَا رَسُولَ اللَّهِ أَرَأَيْتَ إِنْ جَاءَ رَجُلٌ يُرِيدُ أَخْذَ مَالِي؟ قَالَ: «فَلَا تُعْطِهِ مَالَكَ» قَالَ: أَرَأَيْتَ إِنْ قَاتَلَنِي؟ قَالَ: «قَاتِلْهُ» قَالَ: أَرَأَيْتَ إِنْ قَتَلَنِي؟ قَالَ: «فَأَنْتَ شَهِيدٌ» . قَالَ: أَرَأَيْتَ إِنْ قَتَلْتُهُ؟ قَالَ: «هُوَ فِي النَّارِ» . رَوَاهُ مُسلم

He told that he heard God’s Messenger say, “If anyone were to look into your house without receiving your permission and you were to throw a pebble at him and put out his eye, you would be guilty of no offence.” (Bukhari and Muslim)

وَعَنْهُ أَنَّهُ سَمِعَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: «لَوِ اطَّلَعَ فِي بَيْتِكَ أحدٌ ولمْ تَأذن لَهُ فخذفته بحصاة ففتأت عَيْنَهُ مَا كَانَ عَلَيْكَ مِنْ جُنَاحٍ»

Sahl b. Sa'd said that a man looked through a hole in God’s Messenger’s door when God’s Messenger had a spike with which he was scratching his head, so he said, “If I knew that you were seeing me I would poke it in your eyes, for asking permission has been appointed only on account of what people may see.” (Bukhari and Muslim.)

وَعَن سهل بنِ سعد: أَنَّ رَجُلًا اطَّلَعَ فِي جُحْرٍ فِي بَابِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَمَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِدْرًى يَحُكُّ بِهِ رَأْسَهُ فَقَالَ: «لَوْ أَعْلَمُ أَنَّكَ تنظُرُني لطَعَنْتُ بهِ فِي عَيْنَيْكَ إِنَّمَا جُعِلَ الِاسْتِئْذَانُ مِنْ أَجْلِ الْبَصَرِ»

'Abdallah b. Mughaffal told that he saw a man throwing pebbles and told him not to do so, for God’s Messenger had forbidden it, saying, “Game is not caught by such means, neither is an enemy injured, but you may sometimes break a tooth or put out an eye.” (Bukhari and Muslim.)

وَعَنْ عَبْدِ اللَّهِ بْنِ مُغَفَّلٍ أَنَّهُ رَأَى رَجُلًا يَخْذِفُ فَقَالَ: لَا تَخْذِفْ فَإِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنِ الْخَذْفِ وَقَالَ: «إِنَّهُ لَا يُصَادُ بِهِ صَيْدٌ وَلَا يُنْكَأُ بِهِ عَدُوٌّ وَلَكِنَّهَا قَدْ تَكْسِرُ السِّنَّ وَتَفْقَأُ الْعَيْنَ»

Abu Musa reported God’s Messenger as saying, “When one of you passes along in our mosque or in our market having arrows with him he should grasp their points lest he cause any injury by them to a Muslim.” (Bukhari and Muslim.)

وَعَنْ أَبِي مُوسَى قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «إِذَا مَرَّ أَحَدُكُمْ فِي مَسْجِدِنَا وَفِي سُوقِنَا وَمَعَهُ نَبْلٌ فَلْيُمْسِكْ عَلَى نِصَالِهَا أَنْ يُصِيبَ أَحَدًا مِنَ الْمُسْلِمِينَ مِنْهَا بِشَيْءٍ»

Abu Huraira reported God’s Messenger as saying, “None of you must point a weapon at his brother, for he does not know whether perhaps the devil may draw it out while it is in his hand as a result of which he will fall into a pit in hell.” (Bukhari and Muslim.)

وَعَنْ أَبِي هُرَيْرَةَ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لَا يُشِيرُ أَحَدُكُمْ عَلَى أَخِيهِ بِالسِّلَاحِ فَإِنَّهُ لَا يَدْرِي لَعَلَّ الشَّيْطَانَ يَنْزِعُ فِي يَدِهِ فَيَقَعُ فِي حُفْرَة من النَّار»

He reported God’s Messenger as saying, “If anyone points a piece of iron at his brother the angels will curse him till he puts it down, even if he is his brother who has the same father and mother.” Bukhari transmitted it.

وَعَنْهُ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنْ أَشَارَ إِلَى أَخِيهِ بِحَدِيدَةٍ فَإِنَّ الْمَلَائِكَةَ تَلْعَنُهُ حَتَّى يَضَعَهَا وَإِنْ كَانَ أخاهُ لأبيهِ وَأمه» . رَوَاهُ البُخَارِيّ

Ibn ‘Umar and Abu Huraira reported the Prophet (ﷺ) as saying, “He who points a weapon at us does not belong to us.” Bukhari transmitted it, and Muslim added, “And he who treats us dishonestly does not belong to us.”

وَعَنِ ابْنِ عُمَرَ وَأَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُمْ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «مَنْ حَمَلَ عَلَيْنَا السِّلَاحَ فَلَيْسَ مِنَّا» . رَوَاهُ البُخَارِيّ وزادَ مُسلم: «ومنْ غشَّنا فليسَ منَّا»

Salama b. al-Akwa' reported God’s Messenger as saying, “He who draws a sword against us does not belong to us.” Muslim transmitted it.

وَعَنْ سَلَمَةَ بْنِ الْأَكْوَعِ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنْ سَلَّ علينا السَّيفَ فليسَ منَّا» . رَوَاهُ مُسلم

Hisham b. ‘Urwa, on his father’s authority, told that Hisham b. Hakim came upon some Nabataeans in Syria who had been made to stand in the sun with olive-oil poured over their heads. On his asking what the meaning of that was and being told that they were suffering punishment concerning the land-tax, Hisham said he could testify to having heard God’s Messenger say, “God will punish those who punish people in this world.” Muslim transmitted it.

وَعَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ أَنَّ هشامَ بنَ حكيمٍ مَرَّ بِالشَّامِ عَلَى أُنَاسٍ مِنَ الْأَنْبَاطِ وَقَدْ أُقِيموا فِي الشَّمسِ وصُبَّ على رُؤوسِهِمُ الزَّيْتُ فَقَالَ: مَا هَذَا؟ قِيلَ: يُعَذَّبُونَ فِي الخَراجِ فَقَالَ هِشَامٌ: أَشْهَدُ لَسَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: «إِنَّ اللَّهَ يُعَذِّبُ الَّذِينَ يُعذبونَ النَّاسَ فِي الدُّنْيَا» . رَوَاهُ مُسلم

Abu Huraira reported God’s Messenger as saying, “If you live long you will soon see people with things like ox-tails in their hands going out in the morning subject to God’s anger and coming back in the evening subject to God’s displeasure.” A version has, “coming back in the evening subject to God’s curse.” Muslim transmitted it.

وَعَنْ أَبِي هُرَيْرَةَ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «يُوشِكُ إِنْ طَالَتْ بك مُدَّة أَن ترى أَقْوَامًا فِي أَيْدِيهِمْ مِثْلُ أَذْنَابِ الْبَقَرِ يَغْدُونَ فِي غَضَبِ اللَّهِ وَيَرُوحُونَ فِي سَخَطِ اللَّهِ» . وَفِي رِوَايَةٍ: «وَيَرُوحُونَ فِي لَعْنَةِ اللَّهِ» . رَوَاهُ مُسْلِمٌ

He reported God’s Messenger as saying, “There are two classes of those who will go to hell whom I have not seen

people with whips like ox-tails with which they strike people; and women with such clothing as to be virtually naked, who incite men and are inclined towards men, whose heads are like the swaying humps of Bactrian camels. Such women will not enter paradise or experience its fragrance, though its fragrance can be experienced at such and such a distance.” Muslim transmitted it.

وَعَنْهُ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: " صِنْفَانِ مِنْ أَهْلِ النَّارِ لَمْ أَرَهُمَا: قَوْمٌ مَعَهُمْ سِيَاطٌ كَأَذْنَابِ الْبَقَرِ يَضْرِبُونَ بِهَا النَّاسَ وَنِسَاءٌ كَاسِيَاتٌ عَارِيَاتٌ مُمِيلَاتٌ مَائِلَاتٌ رؤوسهم كَأَسْنِمَةِ الْبُخْتِ الْمَائِلَةِ لَا يَدْخُلْنَ الْجَنَّةَ وَلَا يَجِدْنَ رِيحَهَا وَإِنَّ رِيحَهَا لَتُوجَدُ مِنْ مَسِيرَةِ كَذَا وَكَذَا ". رَوَاهُ مُسلم

He reported God’s Messenger as saying, “When any of you fights he must avoid the face, for God created Adam in His own image.” (Bukhari and Muslim.)

وَعَنْهُ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «إِذَا قَاتَلَ أَحَدُكُمْ فَلْيَجْتَنِبِ الْوَجْهَ فَإِنَّ اللَّهَ خَلَقَ آدَمَ عَلَى صُورَتِهِ»

Abu Dharr reported God’s Messenger as saying, “If anyone removes a curtain and looks into a house before receiving permission and sees anything in those within which should not be seen, he has committed an offence which it is not lawful for him to commit. If a man confronted him when he looked in and put out his eye, I would not blame him; but if a man passes a door which has no curtain and is not shut and looks in, he has committed no sin, for the sin pertains only to the people inside.” Tirmidhi transmitted it, saying this is a gharib tradition.

عَنْ أَبِي ذَرٍّ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنْ كَشَفَ سِتْرًا فَأَدْخَلَ بَصَرَهُ فِي الْبَيْتِ قَبْلَ أَنْ يُؤْذَنَ لَهُ فَرَأَى عَوْرَةَ أَهْلِهِ فَقَدْ أَتَى حَدًّا لَا يَحِلُّ لَهُ أَنْ يَأْتِيَهُ وَلَوْ أَنَّهُ حِينَ أَدْخَلَ بَصَرَهُ فَاسْتَقْبَلَهُ رَجُلٌ فَفَقَأَ عَيْنَهُ مَا عَيَّرْتُ عَلَيْهِ وَإِنْ مَرَّ الرَّجُلُ عَلَى بَابٍ لَا سِتْرَ لَهُ غَيْرِ مُغْلَقٍ فَنَظَرَ فَلَا خَطِيئَةَ عَلَيْهِ إِنَّمَا الْخَطِيئَةُ عَلَى أَهْلِ الْبَيْتِ» . رَوَاهُ التِّرْمِذِيُّ وَقَالَ: هَذَا حَدِيثٌ غَرِيب

Jabir said God’s Messenger forbade that a sword which has been drawn should be handed to anyone. Tirmidhi and Abu Dawud transmitted it.

وَعَنْ جَابِرٍ قَالَ: نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يُتَعَاطَى السَّيْفُ مَسْلُولًا. رَوَاهُ التِّرْمِذِيّ وَأَبُو دَاوُد

Al-Hasan said on Samura’s authority that God’s Messenger forbade that a thong of a sandal should be cut off between two toes. Abu Dawud transmitted it.

وَعَن الحسنِ عَنْ سَمُرَةَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى أَنْ يُقَدَّ السَّيْرُ بَيْنَ أُصبعَينِ. رَوَاهُ أَبُو دَاوُد

Sa'id b. Zaid reported God’s Messenger as saying, “He who is killed in defence of his religion is a martyr, he who is killed in self-defence is a martyr, he who is killed in defence of his property is a martyr, and he who is killed in defence of his family is a martyr.” Tirmidhi, Abu Dawud and Nasa’i transmitted it.

وَعَن سعيدِ بنِ زيدٍ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «مَنْ قُتِلَ دُونَ دِينِهِ فَهُوَ شَهِيدٌ وَمَنْ قُتِلَ دُونَ دَمِهِ فَهُوَ شَهِيدٌ وَمَنْ قُتِلَ دُونَ مَالِهِ فَهُوَ شَهِيدٌ وَمَنْ قُتِلَ دُونَ أَهْلِهِ فَهُوَ شَهِيدٌ» . رَوَاهُ التِّرْمِذِيُّ وَأَبُو دَاوُدَ وَالنَّسَائِيُّ

Ibn ‘Umar reported the Prophet (ﷺ) as saying, ‘‘Jahannam has seven gates, one of which is for those who draw a sword against my people,” or he said, "against Muhammad’s people.” Tirmidhi transmitted it, saying this is a gharib tradition.

وَعَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: " لِجَهَنَّمَ سَبْعَةُ أَبْوَابٍ: بَابٌ مِنْهَا لِمَنْ سَلَّ السَّيْفَ عَلَى أُمَّتِي أَوْ قَالَ: عَلَى أُمَّةِ مُحَمَّدٍ ". رَوَاهُ التِّرْمِذِيُّ وَقَالَ: هَذَا حَدِيثٌ غَرِيبٌ

Rafi' b. Khadij and Sahl b. Abu Hathma told that ‘Abdallah b. Sahl and Muhayyisa b. Mas'ud came to Khaibar and when they had separated among the palm-trees ‘Abdallah b. Sahl was killed. ‘Abd ar-Rah¬man b. Sahl and Huwayyisa, and Muhayyisa, the sons of Mas'ud, came to the Prophet (ﷺ) and spoke about what had happened to their friend. ‘Abd ar-Rahman who was the youngest spoke first, but the Prophet (ﷺ) said to him kabbir al-kubr, which was said by Yahya b. Sa'id to mean “Let the oldest take charge of speaking." They then spoke and the Prophet (ﷺ) said, “Make your demand regarding your dead man (or he said, your friend) by the oaths of fifty of you." They replied, “Messenger of God, it is a matter which we did not see." He said, “The Jews will exonerate themselves by the oaths of fifty of them," but they replied, “Messenger of God, they are a people who are infidels." So God’s Messenger paid them the blood wit himself. A version has, “You must swear fifty oaths and make your claim regarding your slain man (or, your friend)." Then God’s Messenger himself paid his blood wit consisting of a hundred she- camels. (Bukhari and Muslim.)

عَنْ رَافِعِ بْنِ خَدِيجٍ وَسَهْلِ بْنِ أَبِي حَثْمة أَنَّهُمَا حَدَّثَا أَنَّ عَبْدَ اللَّهِ بْنَ سَهْلٍ وَمُحَيِّصَةَ بْنَ مَسْعُودٍ أَتَيَا خَيْبَرَ فَتَفَرَّقَا فِي النَّخْلِ فَقُتِلَ عَبْدُ اللَّهِ بْنُ سَهْلٍ فَجَاءَ عَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ وَحُوَيِّصَةُ وَمُحَيِّصَةُ ابْنَا مَسْعُودٍ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَتَكَلَّمُوا فِي أَمْرِ صَاحِبِهِمْ فَبَدَأَ عَبْدُ الرَّحْمَنِ وَكَانَ أَصْغَر الْقَوْم فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: " كبر الْكبر قَالَ يحيى بن سعد: يَعْنِي لِيَلِيَ الْكَلَامَ الْأَكْبَرُ فَتَكَلَّمُوا فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «اسْتَحِقُّوا قَتِيلَكُمْ أَوْ قَالَ صَاحِبَكُمْ بِأَيْمَانِ خَمْسِينَ مِنْكُمْ» . قَالُوا: يَا رَسُولَ اللَّهِ أَمْرٌ لَمْ نَرَهُ قَالَ: فَتُبَرِّئُكُمْ يَهُودُ فِي أَيْمَانِ خَمْسِينَ مِنْهُمْ؟ قَالُوا: يَا رَسُولَ اللَّهِ قَوْمٌ كُفَّارٌ فَفَدَاهُمْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ قِبَلِهِ. وَفِي رِوَايَةٍ: «تَحْلِفُونَ خَمْسِينَ يَمِينًا وَتَسْتَحِقُّونَ قَاتِلَكُمْ أَوْ صَاحِبَكُمْ» فَوَدَاهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَنْ عِنْده بِمِائَة نَاقَة

Rafi‘ b. Khadij said that one of the Ansar was killed at Khaibar and his relatives went to the Prophet (ﷺ) and mentioned that to him. He asked, “Have you two witnesses who can testify to the murderer of your friend?" They replied, “Messenger of God, there was not a single Muslim present, but only Jews who sometimes have the audacity to do even greater crimes than this “He said, “Then choose fifty of them and demand that they take an oath;" but they refused and God’s Messenger paid his blood wit himself. Abu Dawud transmitted it.

عَنْ رَافِعِ بْنِ خَدِيجٍ قَالَ: أَصْبَحَ رَجُلٌ مِنَ الْأَنْصَارِ مَقْتُولًا بِخَيْبَرَ فَانْطَلَقَ أَوْلِيَاؤُهُ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرُوا ذَلِكَ لَهُ فَقَالَ: «أَلَكُمْ شَاهِدَانِ يَشْهَدَانِ عَلَى قَاتِلِ صَاحِبِكُمْ؟» قَالُوا: يَا رَسُولَ اللَّهِ لَمْ يَكُنْ ثَمَّ أحدٌ من المسلمينَ وإِنما هُوَ يهود وَقد يجترئون عَلَى أَعْظَمَ مِنْ هَذَا قَالَ: «فَاخْتَارُوا مِنْهُمْ خَمْسِينَ فَاسْتَحْلِفُوهُمْ» . فَأَبَوْا فَوَدَاهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ عِنْدِهِ. رَوَاهُ أَبُو دَاوُد

‘Ikrima told that when some heretics were brought to ‘Ali he had them burned, and that when Ibn ‘Abbas heard of it he said that if it had been he, he would not have had them burned because of God’s Messenger's prohibition, “Do not inflict God’s punishment on anyone”, but would have had them killed on account of the statement made by God’s Messenger, “Kill those who change their religion.” Bukhari transmitted it.

عَنْ عِكْرِمَةَ قَالَ: أُتِيَ عَلِيٌّ بِزَنَادِقَةٍ فَأَحْرَقَهُمْ فَبَلَغَ ذَلِكَ ابْنَ عَبَّاسٍ فَقَالَ: لَوْ كُنْتُ أَنَا لَمْ أُحْرِقْهُمْ لِنَهْيِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لَا تُعَذِّبُوا بِعَذَابِ اللَّهِ» وَلَقَتَلْتُهُمْ لِقَوْلِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنْ بَدَّلَ دِينَهُ فَاقْتُلُوهُ» . رَوَاهُ الْبُخَارِيُّ

‘Abdallah b. ‘Abbas reported God’s Messenger as saying, “Only God punishes with fire.” Bukhari transmitted it.

وَعَنْ عَبْدِ اللَّهِ بْنِ عَبَّاسٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسلم: «إِن النَّارَ لَا يُعَذِّبُ بِهَا إِلَّا اللَّهُ» . رَوَاهُ البُخَارِيّ

‘Ali told that he heard God’s Messenger say, “In the last time people will come forth, young and foolish, speaking the finest words men speak, but their faith will not pass their throats. They will come out from the religion as an arrow does from the animal it is aimed at. Wherever you meet them kill them, for a reward for killing them will be given on the day of resurrection to those who kill them.” (Bukhari and Muslim.)

وَعَنْ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ قَالَ: سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: «سَيَخْرُجُ قَوْمٌ فِي آخِرِ الزَّمَانِ حُدَّاثُ الْأَسْنَانِ سُفَهَاءُ الْأَحْلَامِ يَقُولُونَ مِنْ خَيْرِ قَوْلِ الْبَرِيَّةِ لَا يُجَاوِزُ إِيمَانُهُمْ حَنَاجِرَهُمْ يَمْرُقُونَ مِنَ الدِّينِ كَمَا يَمْرُقُ السَّهْمُ مِنَ الرَّمِيَّةِ فَأَيْنَمَا لَقِيتُمُوهُمْ فَاقْتُلُوهُمْ فَإِنَّ فِي قَتْلِهِمْ أَجْرًا لمن قَتلهمْ يَوْم الْقِيَامَة»

Abu Sa'id al-Khudri reported God’s Messenger as saying, “My people will be in two sections from among whom a seceding party will go out, and those who are nearest to the truth will undertake the killing of them.” Muslim transmitted it.

وَعَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «يَكُونُ أُمَّتِي فِرْقَتَيْنِ فَيَخْرُجُ مِنْ بَيْنِهِمَا مَارِقَةٌ يَلِي قَتْلَهُمْ أولاهم بِالْحَقِّ» . رَوَاهُ مُسلم

Jarir reported God’s Messenger as saying at the Farewell Pilgrimage, “You must never revert to infidelity after my death and cut off one another’s heads.” (Bukhari and Muslim.)

وَعَنْ جَرِيرٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي حَجَّةِ الْوَدَاعِ: «لَا تَرْجِعُنَّ بَعْدِي كُفَّارًا يَضْرِبُ بَعْضُكُمْ رِقَاب بعض»

Abu Bakra reported the Prophet (ﷺ) as saying, “When two Muslims meet and one of them bears arms against his brother, they are both on the brink of hell, and if one of them kills the other they will both enter it.” In a version on Abu Bakra's authority he said, “When two Muslims meet with their swords, the one who kills and the one who is killed will go to hell." When he (i.e. Abu Bakr) remarked that one was the killer and asked what was wrong with the one who was killed, he replied, “He was eager to kill his companion." (Bukhari and Muslim.)

وَعَنْ أَبِي بَكْرَةَ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «إِذَا الْتَقَى الْمُسْلِمَانِ حَمَلَ أَحَدُهُمَا عَلَى أَخِيهِ السِّلَاحَ فَهُمَا فِي جُرُفِ جَهَنَّمَ فَإِذَا قَتَلَ أَحَدُهُمَا صَاحِبَهُ دَخَلَاهَا جَمِيعًا» . وَفِي رِوَايَةٍ عَنْهُ: قَالَ: «إِذَا الْتَقَى الْمُسْلِمَانِ بسيفهما فَالْقَاتِلُ وَالْمَقْتُولُ فِي النَّارِ» قُلْتُ: هَذَا الْقَاتِلُ فَمَا بَالُ الْمَقْتُولِ؟ قَالَ: «إِنَّهُ كَانَ حَرِيصًا عَلَى قَتْلِ صَاحِبِهِ»

Anas told that some people of ‘Ukl who had come to the Prophet (ﷺ) and accepted Islam found Medina unhealthy, so he ordered them to go to the camels of the sadaqa and drink some of their urine and their milk. They did so and became well, after which they apostatised, killed the herdsmen and drove off the camels. So he sent people in pursuit of them, and when they were brought he had their hands and feet cut off and their eyes put out and left them to die without cauterising them to stop the flow of blood. A version says nails were driven into their eyes. Another says he ordered nails to be heated and after having them blinded with them he had them thrown out on the harra, and although they begged for water they were left to die without being given any. (Bukhari and Muslim.)

وَعَن أَنَسٍ قَالَ: قَدِمَ عَلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَفَرٌ مِنْ عُكْلٍ فَأَسْلَمُوا فَاجْتَوَوُا الْمَدِينَةَ فَأَمَرَهُمْ أَنْ يَأْتُوا إِبِلَ الصَّدَقَةِ فَيَشْرَبُوا مِنْ أَبْوَالِهَا وَأَلْبَانِهَا فَفَعَلُوا فَصَحُّوا فَارْتَدُّوا وَقَتَلُوا رُعَاتَهَا وَاسْتَاقُوا الْإِبِلَ فَبَعَثَ فِي آثَارِهِمْ فَأُتِيَ بِهِمْ فَقَطَعَ أَيْدِيَهُمْ وَأَرْجُلَهُمْ وَسَمَلَ أَعْيُنَهُمْ ثُمَّ لَمْ يَحْسِمْهُمْ حَتَّى مَاتُوا ". وَفِي رِوَايَةٍ: فَسَمَّرُوا أَعْيُنَهُمْ وَفِي رِوَايَةٍ: أَمَرَ بِمَسَامِيرَ فَأُحْمِيَتْ فَكَحَّلَهُمْ بِهَا وَطَرَحَهُمْ بِالْحَرَّةِ يَسْتَسْقُونَ فَمَا يُسْقَوْنَ حَتَّى مَاتُوا

‘Imran b. Husain said God's Messenger used to urge them to give sadaqa and forbid them to mutilate anyone. Aba Dawud transmitted it and Nasa’i transmitted it on the authority of Anas.

عَنْ عِمْرَانَ بْنِ حُصَيْنٍ قَالَ: كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَحُثُّنَا عَلَى الصَّدَقَةِ وَيَنْهَانَا عَنِ الْمُثْلَةِ. رَوَاهُ أَبُو دَاوُدَ وَرَوَاهُ النَّسَائِيّ عَن أنس

‘Abd ar-Rahman b. Abdallah quoted his father as saying

When I we were on a journey with God’s Messenger and he had gone to relieve himself we saw a hummara* with two young ones and took the young ones, whereupon the hummara came and began to spread out its wings. Then when the Prophet (ﷺ) came he said, “Who has pained this one by the loss of her young? Give her young ones back to her." He also saw an anthill which we had burned, and when he asked who had burned it and we replied that we had, he said, “It is not fitting that anyone but the Lord of the fire should punish with fire” Abu Dawud transmitted it. * A small bird like a sparrow, or a lark.

وَعَنْ عَبْدِ الرَّحْمَنِ بْنِ عَبْدِ اللَّهِ عَنْ أَبِيهِ قَالَ: كُنَّا مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي سَفَرٍ فَانْطَلَقَ لِحَاجَتِهِ فَرَأَيْنَا حُمْرَةً مَعَهَا فَرْخَانِ فَأَخَذْنَا فَرْخَيْهَا فَجَاءَتِ الْحُمْرَةُ فَجَعَلَتْ تَفْرُشُ فَجَاءَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «مَنْ فَجَعَ هَذِهِ بِوَلَدِهَا؟ رُدُّوا وَلَدَهَا إِلَيْهَا» . وَرَأَى قَرْيَةَ نَمْلٍ قَدْ حَرَّقْنَاهَا قَالَ: «مَنْ حَرَّقَ هَذِهِ؟» فَقُلْنَا: نَحْنُ قَالَ: «إِنَّهُ لَا يَنْبَغِي أَنْ يُعَذِّبَ بِالنَّارِ إِلاَّ ربُّ النَّار» . رَوَاهُ أَبُو دَاوُد

Abu Sa'id al-Khudri and Anas b Malik reported God’s Messenger as saying, “Disagreement and division will arise among my people. Some will speak well but do evil; they will recite the Qur’an but it will go no farther than their throats; they will swerve from the religion as an arrow goes through the animal shot at and will not return till an arrow comes back to the place where it was strung. They are the worst of men and animals. Blessed are they who kill them and are killed by them! They summon people to God’s Book, but they have no part with us. He who fights with them is nearer to God than they.” God’s Messenger was asked what mark they had, and said it was shaving.* Abu Dawud transmitted it. * Tahliq is here explained as going to extremes in shaving the head and taking the hair out by the roots.

وَعَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ وَأَنَسِ بْنِ مَالِكٍ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: " سَيَكُونُ فِي أُمَّتِي اخْتِلَافٌ وَفُرْقَةٌ قَوْمٌ يُحسِنونَ القيلَ ويُسيئونَ الفِعلَ يقرؤون الْقُرْآنَ لَا يُجَاوِزُ تَرَاقِيَهُمْ يَمْرُقُونَ مِنَ الدِّينِ مُروقَ السَّهمِ فِي الرَّمِيَّةِ لَا يَرْجِعُونَ حَتَّى يَرْتَدَّ السَّهْمُ عَلَى فُوقِهِ هُمْ شَرُّ الْخَلْقِ وَالْخَلِيقَةِ طُوبَى لِمَنْ قَتَلَهُمْ وَقَتَلُوهُ يَدْعُونَ إِلَى كِتَابِ اللَّهِ وَلَيْسُوا منَّا فِي شيءٍ مَنْ قاتلَهم كَانَ أَوْلَى بِاللَّهِ مِنْهُمْ قَالُوا: يَا رَسُولَ اللَّهِ مَا سِيمَاهُمْ؟ قَالَ: «التَّحْلِيقُ» . رَوَاهُ أَبُو دَاوُد

A’isha reported God’s Messenger as saying, “The blood of a Muslim man who testifies that there is no god but God and that Muhammad is God’s Messenger may lawfully be shed only for one of three reasons

fornication after marriage, in which case he should be stoned; one who goes forth to fight with God and His Messenger,* in which case he should be killed, or crucified, or made a fugitive; or one which commits murder for which he is killed.” Abu Dawud transmitted it. * Mirqat iv. 53 refers this to such things as highway robbery.

وَعَنْ عَائِشَةَ قَالَتْ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لَا يَحِلُّ دَمُ امْرِئٍ مُسْلِمٍ يَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللَّهُ وَأَنَّ مُحَمَّدًا رَسُولُ اللَّهِ إِلَّا بِإِحْدَى ثَلَاثٍ زِنا بعدَ إِحْصانٍ فإِنَّهُ يُرجَمُ ورجلٌ خرَجَ مُحارِباً للَّهِ وَرَسُولِهِ فَإِنَّهُ يُقْتَلُ أَوْ يُصْلَبُ أَوْ يُنْفَى مِنَ الْأَرْضِ أَوْ يَقْتُلُ نَفْسًا فَيُقْتَلُ بِهَا» . رَوَاهُ أَبُو دَاوُد

Ibn Abu Laila said he was told by Muhammad’s companions that during a journey with God’s Messenger while one of them was asleep another went to a rope he had with him and seized him,* with the result that he was startled. God’s Messenger then said, “It is not lawful for a Muslim to frighten another.” Abu Dawud transmitted it. * The meaning is that he tied the rope round him while he was asleep, presumably as a joke.

وَعَنِ ابْنِ أَبِي لَيْلَى قَالَ: حَدَّثَنَا أَصْحَابُ مُحَمَّدٍ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُمْ كَانُوا يَسِيرُونَ مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَنَامَ رَجُلٌ مِنْهُمْ فَانْطَلَقَ بَعْضُهُمْ إِلَى حَبْلٍ مَعَه فَأَخذه فَفَزعَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لَا يَحِلُّ لِمُسْلِمٍ أَنْ يُرَوِّعَ مُسْلِمًا» . رَوَاهُ أَبُو دَاوُد

Abud Darda’ reported God’s Messenger as saying, “He who gets land on which tax is due 1 has sought to rescind his emigration,2 and he who takes an infidel’s lowliness from his neck and puts it on his own 3 has turned his back on Islam.” Abu Dawud transmitted it. 1. The word for "tax" here is jizya. Eventually a distinction was made between jizya and kharaj, the former being used for poll-tax and the latter for land-tax. 2. i.e. to make himself like a dhimmi. 3. i.e. undertakes the responsibility of paying his tax for him.

وَعَنْ أَبِي الدَّرْدَاءِ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «مَنْ أَخَذَ أَرْضًا بِجِزْيَتِهَا فَقَدِ اسْتَقَالَ هِجْرَتَهُ وَمَنْ نَزَعَ صَغَارَ كَافِرٍ مِنْ عُنُقِهِ فَجَعَلَهُ فِي عُنُقِهِ فَقَدْ وَلّى الإِسلامَ ظهرَه» . رَوَاهُ أَبُو دَاوُد

Jarir b. ‘Abdillah told that when God’s Messenger sent an expedition to Khath'am some of them sought God’s protection by having recourse to prostration* and were quickly killed. When the Prophet (ﷺ) heard that, he ordered half the blood wit to be paid for them, saying, “I am not responsible for any Muslim who stays among polytheists.” On being asked why that was, he replied, “Their fires should not be visible to one another.” Abu Dawud transmitted it. * Some members of Khath'am who were Muslims prostrated themselves in prayer to God thinking that this would make it clear to the attackers that they were Muslims.

وَعَنْ جَرِيرِ بْنِ عَبْدِ اللَّهِ قَالَ: بَعَثَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سَرِيَّةً إِلَى خَثْعَمَ فَاعْتَصَمَ نَاسٌ مِنْهُمْ بِالسُّجُودِ فَأَسْرَعَ فِيهِمُ الْقَتْلَ فَبَلَغَ ذَلِكَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَمَرَ لَهُمْ بِنِصْفِ الْعَقْلِ وَقَالَ: «أَنَا بَرِيءٌ مِنْ كُلِّ مُسْلِمٍ مُقِيمٍ بَيْنَ أَظْهُرِ الْمُشْرِكِينَ» قَالُوا: يَا رَسُولَ اللَّهِ لِمَ؟ قَالَ: «لَا تَتَرَاءَى نَارَاهُمَا» . رَوَاهُ أَبُو دَاوُدَ

Mishkat al-Masabih 3548

Abu Huraira reported the Prophet (ﷺ) as saying, “Faith is an assurance of safety from being killed unawares. A believer does not kill another unawares.” Abu Dawud transmitted it.

وَعَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «الْإِيمَانُ قَيَّدَ الْفَتْكَ لَا يفتِكُ مُؤمنٌ» . رَوَاهُ أَبُو دَاوُد

Jarir reported the Prophet (ﷺ) as saying, “When a slave runs away and reverts to polytheism he may lawfully be killed.” Abu Dawud transmitted it.

وَعَنْ جَرِيرٍ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «إِذَا أَبَقَ الْعَبْدُ إِلَى الشِّرْكِ فقد حلَّ دَمه» . رَوَاهُ أَبُو دَاوُد

‘Ali told that a Jewess who was reviling the Prophet (ﷺ) and speaking evil of him was strangled to death by a man and the Prophet (ﷺ) allowed no payment to be made for her death. Abu Dawud transmitted it.

وَعَنْ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ أَنَّ يَهُودِيَّةً كَانَتْ تَشْتِمُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَتَقَعُ فِيهِ فَخَنَقَهَا رَجُلٌ حَتَّى مَاتَتْ فَأَبْطَلَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ دَمَهَا. رَوَاهُ أَبُو دَاوُد

Jundub reported God’s Messenger as saying, “The punishment given to a magician is a stroke with the sword.” Tirmidhi transmitted it.

Usama b. Sharik reported God’s Messenger as saying, “Cut off the head of any man who goes out and causes division among my people.” Nasa’i transmitted it.

عَن أُسَامَةَ بْنِ شَرِيكٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «أَيُّمَا رَجُلٍ خَرَجَ يُفَرِّقُ بَيْنَ أُمَّتِي فَاضْرِبُوا عُنُقَهُ» . رَوَاهُ النَّسَائِيُّ

Sharik b. Shihab said

I wanted to meet one of the Prophet’s companions to ask him about the Kharijites. Meeting Abu Barza al-Aslami along with some of his companions on a festival day, I asked him whether he had heard God’s Messenger mentioning the Kharijites, and he replied that he had both heard him with his ears and seen him with his eyes. He told that God’s Messenger was brought some property and divided it, giving something to those on his right and those on his left, but giving nothing to those who were behind him. One of those behind him, a black man whose hair was completely cut off and who was wearing two white garments, then said, "You have not divided justly, Muhammad.” God's Messenger became very angry and said, “I swear by God that after my death you will not find a man more just than I am,” adding, “At the end of time people looking like this man will come forth, reciting the Qur'an, but it will not pass their throats. They will swerve from Islam as an arrow passes through the game at which is it shot, and their distinguishing mark will be shaving. They will continue to come forth till the last of them comes forth with the antichrist. When you meet them they will be the worst of men and beasts.” Nasa’i transmitted it.

وَعَنْ شَرِيكِ بْنِ شِهَابٍ قَالَ: كُنْتُ أَتَمَنَّى أَنْ أَلْقَى رَجُلًا مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَسْأَلُهُ عَنِ الْخَوَارِجِ فَلَقِيْتُ أَبَا بَرْزَةَ فِي يَوْمِ عِيدٍ فِي نَفَرٍ مِنْ أَصْحَابِهِ فَقُلْتُ لَهُ: هَلْ سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَذْكُرُ الْخَوَارِجَ؟ قَالَ: نعمْ سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِأُذُنَيَّ وَرَأَيْتُهُ بِعَيْنَيَّ: أَتَى رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِمَالٍ فَقَسَمَهُ فَأَعْطَى مَنْ عَنْ يَمِينِهِ وَمَنْ عَنْ شِمَالِهِ وَلَمْ يُعْطِ مَنْ وَرَاءَهُ شَيْئًا. فَقَامَ رَجُلٌ مِنْ وَرَائِهِ فَقَالَ: يَا مُحَمَّدُ مَا عَدَلْتَ فِي الْقِسْمَةِ رَجُلٌ أَسْوَدُ مَطْمُومُ الشَّعْرِ عَلَيْهِ ثَوْبَانِ أَبْيَضَانِ فَغَضِبَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ غَضَبًا شَدِيدًا وَقَالَ: «وَاللَّهِ لَا تَجِدُونَ بَعْدِي رَجُلًا هُوَ أَعْدَلُ مِنِّي» ثُمَّ قَالَ: «يخرُجُ فِي آخرِ الزَّمانِ قومٌ كأنَّ هَذَا مِنْهُم يقرؤون الْقُرْآنَ لَا يُجَاوِزُ تَرَاقِيَهُمْ يَمْرُقُونَ مِنَ الْإِسْلَامِ كَمَا يَمْرُقُ السَّهْمُ مِنَ الرَّمِيَّةِ سِيمَاهُمُ التَّحْلِيقُ لَا يَزَالُونَ يَخْرُجُونَ حَتَّى يَخْرُجَ آخِرُهُمْ مَعَ الْمَسِيحِ الدَّجَّالِ فَإِذَا لَقِيتُمُوهُمْ هُمْ شَرُّ الْخَلْقِ والخليقة» . رَوَاهُ النَّسَائِيّ

Mishkat al-Masabih 3554

Abu Ghalib told that when Abu Umama saw some heads set up on the road to Damascus he said, “The dogs of hell, the worst people killed under the sky. The best who have been killed are those killed by them.” He then recited, “On the day when some faces will be white and some faces will be black (Al-Qur’an, 3

106). Abu Umama was asked whether he had heard it from God’s Messenger and replied, “If I had heard it only once, twice, or thrice (counting up to seven times) I would not have told you.” Tirmidhi and Ibn Majah transmitted it, Tirmidhi saying this is a hasan tradition.

وَعَن أبي غالبٍ رأى أَبُو أُمامةَ رؤوساً مَنْصُوبَةً عَلَى دَرَجِ دِمَشْقَ فَقَالَ أَبُو أُمَامَةَ: «كِلَابُ النَّارِ شَرُّ قَتْلَى تَحْتَ أَدِيمِ السَّمَاءِ خَيْرُ قَتْلَى مَنْ قَتَلُوهُ» ثُمَّ قَرَأَ (يَوْمَ تبيَضُّ وُجوهٌ وتَسوَدُّ وُجوهٌ) الْآيَةَ قِيلَ لِأَبِي أُمَامَةَ: أَنْتَ سَمِعْتُ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ؟ قَالَ: لَوْ لَمْ أَسْمَعْهُ إِلَّا مَرَّةً أَوْ مَرَّتَيْنِ أوْ ثَلَاثًا حَتَّى عَدَّ سَبْعًا مَا حَدَّثْتُكُمُوهُ. رَوَاهُ التِّرْمِذِيُّ وَابْنُ مَاجَهْ وَقَالَ التِّرْمِذِيُّ: هَذَا حَدِيثٌ حَسَنٌ

Mishkat al-Masabih 3555

Abu Huraira and Zaid b. Khalid told that two men brought a dispute before God’s Messenger, one of them saying, "Pronounce judgment between us in accordance with God’s Book," and the other saying, "Yes Messenger of God, pronounce judgment between us in accordance with God’s Book, and allow me to speak." He told him to speak and he said, "My son who was a hired servant with this man committed fornication with his wife, and when I was told that my son must be stoned to death I ransomed him with a hundred sheep and a slave girl of mine; but when I asked the learned they told me that my son should receive a hundred lashes and be banished for a year, and that stoning to death applied only to the man’s wife." God’s Messenger replied, "By Him in whose hand my soul is, I shall certainly pronounce judgment between you in accordance with God's Book. Your sheep and your slave girl must be returned to you, and your son shall receive a hundred lashes and be banished for a year. As for you, Unais, go to this man's wife, and if she confesses stone her to death." She confessed and he stoned her. (Bukhari and Muslim.)

عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ: أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ أَحَدُهُمَا: اقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ وَقَالَ الْآخَرُ: أَجَلْ يَا رَسُولَ اللَّهِ فاقْضِ بَيْننَا بكتابِ الله وائذَنْ لِي أَنْ أَتَكَلَّمَ قَالَ: «تَكَلَّمْ» قَالَ: إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ فَأَخْبرُونِي أنَّ على ابْني الرَّجْم فاقتديت مِنْهُ بِمِائَةِ شَاةٍ وَبِجَارِيَةٍ لِي ثُمَّ إِنِّي سَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ وَإِنَّمَا الرَّجْمُ عَلَى امْرَأَتِهِ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «أَمَا وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ أَمَّا غَنَمُكَ وَجَارِيَتُكَ فَرَدٌّ عَلَيْكَ وَأَمَّا ابْنُكَ فَعَلَيْهِ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَأَمَّا أَنْتَ يَا أُنَيْسُ فَاغْدُ إِلَى امْرَأَةِ هَذَا فَإِن اعْترفت فارجمها» فَاعْترفت فرجمها

Zaid b. Khalid told that he heard God’s Messenger giving command that an unmarried man who committed fornication should receive a hundred lashes and be banished for a year. Bukhari transmitted it.

وَعَنْ زَيْدِ بْنِ خَالِدٍ قَالَ: سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَأْمُرُ فِيمَنْ زَنَى وَلَمْ يُحْصَنْ جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ. رَوَاهُ البُخَارِيّ

‘Umar said

God sent Muhammad with the truth and sent down the Book to him, and the verse of stoning was included in what God most high sent down. God's Messenger had people stoned to death and we have done it also since his death. Stoning is a duty laid down in God’s Book for married men and women who commit fornication when proof is established, or if there is pregnancy, or a confession. (Bukhari and Muslim.)

وَعَنْ عُمَرَ رَضِيَ اللَّهُ عَنْهُ قَالَ: إِن الله بعث مُحَمَّدًا وَأَنْزَلَ عَلَيْهِ الْكِتَابَ فَكَانَ مِمَّا أَنْزَلَ اللَّهُ تَعَالَى آيَةُ الرَّجْمِ رَجَمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَرَجَمْنَا بَعْدَهُ وَالرَّجْمُ فِي كِتَابِ اللَّهِ حَقٌّ عَلَى مَنْ زَنَى إِذَا أُحْصِنَ مِنَ الرِّجَالِ وَالنِّسَاءِ إِذَا قَامَتِ الْبَيِّنَةُ أَوْ كانَ الحَبَلُ أَو الِاعْتِرَاف

‘Ubada b. as-Samit reported the Prophet (ﷺ) as saying, “Receive my teaching, receive my teaching God has appointed a way for those women (Cf. Al-Qur'an, 4

15). When the parties are unmarried they shall receive a hundred lashes and be banished for a year when they commit fornication and when they have been married they shall receive a hundred lashes and be stoned to death.” Muslim transmitted it.

وَعَنْ عُبَادَةَ بْنِ الصَّامِتِ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: " خُذُوا عَنِّي خُذُوا عَنِّي قَدْ جَعَلَ اللَّهُ لَهُنَّ سَبِيلًا: الْبِكْرُ بالبكر جلد مائَة ووتغريب عَام وَالثَّيِّب بِالثَّيِّبِ جلد مائَة وَالرَّجم "

‘Abdallah b. ‘Umar told that the Jews came to God’s Messenger and mentioned to him that a man and a woman of their number had committed fornication. He asked them what they found in the Torah about stoning and they replied that they should disgrace them and that they should be beaten. ‘Abdallah b. Salam then said, “You lie; it contains instruction that they should be stoned to death, so bring the Torah.” They spread it out, and one of them put his hand over the verse of stoning and read what preceded it and what followed it. 'Abdallah b. Salam told him to lift his hand and when he did so the verse of stoning was seen to be in it. They then said, “He has spoken the truth, Muhammad; the verse of stoning is in it.” The Prophet (ﷺ) then gave command regarding them and they were stoned to death. In a version it says that he told him to lift his hand and that when he did so the verse of stoning was clearly in it. The man then said, “It contains the verse of stoning, Muhammad, but we have been concealing it from one another.” He then gave command regarding them and they were stoned to death. (Bukhari and Muslim.)

وَعَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ: أَن الْيَهُود جاؤوا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرُوا لَهُ أَنَّ رَجُلًا مِنْهُمْ وَامْرَأَةً زَنَيَا فَقَالَ لَهُمْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَا تَجِدُونَ فِي التَّوْرَاةِ فِي شَأْنِ الرَّجْمِ؟» قَالُوا: نَفْضَحُهُمْ وَيُجْلَدُونَ قَالَ عَبْدُ اللَّهِ بْنُ سَلَامٍ: كَذَبْتُمْ إِنَّ فِيهَا الرَّجْمَ فَأْتُوا بِالتَّوْرَاةِ فَنَشَرُوهَا فَوَضَعَ أَحَدُهُمْ يَدَهُ عَلَى آيَةِ الرَّجْمِ فَقَرَأَ مَا قَبْلَهَا وَمَا بَعْدَهَا فَقَالَ عَبْدُ اللَّهِ بْنُ سَلَامٍ: ارْفَعْ يَدَكَ فَرَفَعَ فإِذا فِيهَا آيةُ الرَّجم. فَقَالُوا: صدقَ يَا محمَّدُ فِيهَا آيَة الرَّجْم. فَأمر بهما النَّبِي صلى اللَّهُ عَلَيْهِ وَسَلَّمَ فَرُجِمَا. وَفِي رِوَايَةٍ: قَالَ: ارْفَعْ يَدَكَ فَرَفَعَ فَإِذَا فِيهَا آيَةُ الرَّجْمِ تَلُوحُ فَقَالَ: يَا مُحَمَّدُ إِنَّ فِيهَا آيَةَ الرَّجْمِ وَلِكِنَّا نَتَكَاتَمُهُ بَيْنَنَا فَأَمَرَ بِهِمَا فَرُجِمَا

Mishkat al-Masabih 3560

Abu Huraira told of a man who came to the Prophet (ﷺ) when he was in the mosque and called to him, “Messenger of God, I have committed fornication ” The Prophet (ﷺ) turned away from him, so the man came round facing him and said, “I have committed fornication,” but the Prophet (ﷺ) turned away. Then when he had testified four times the Prophet (ﷺ) called him and said, “Are you mad?” When he replied that he was not he asked him if he was married, and when he replied that he was, God’s Messenger said, “Take him away and stone him to death.” Ibn Shihab said

I was informed by one who heard Jabir b. ‘Abdallah say, “Then we stoned him in Medina, but when the stones hurt him he ran away, and we caught up on him in the harra and stoned him to death.” In aversion by Bukhari on Jabir’s authority, after “he replied that he was” it says that he gave command regarding him and he was stoned in the place of prayer. Then when the stones hurt him he fled, but was overtaken and stoned to death. The Prophet (ﷺ) then spoke well of him and prayed over him. (Bukhari and Muslim.)

وَعَنْ أَبِي هُرَيْرَةَ قَالَ: أَتَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ رَجُلٌ وَهُوَ فِي الْمَسْجِدِ فَنَادَاهُ: يَا رَسُولَ اللَّهِ إِنِّي زَنَيْتُ فَأَعْرَضَ عَنْهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَتَنَحَّى لِشِقِّ وَجْهِهِ الَّذِي أَعْرَضَ قِبَلَهُ فَقَالَ: إِنِّي زَنَيْتُ فَأَعْرَضَ عَنْهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَلَمَّا شَهِدَ أَرْبَعَ شَهَادَاتٍ دَعَاهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «أَبِكَ جُنُونٌ؟» قَالَ: لَا فَقَالَ: «أُحْصِنْتَ؟» قَالَ: نَعَمْ يَا رَسُولَ اللَّهِ قَالَ: «اذْهَبُوا بِهِ فَارْجُمُوهُ» قَالَ ابْنُ شِهَابٍ: فَأَخْبَرَنِي مَنْ سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ يَقُولُ: فَرَجَمْنَاهُ بِالْمَدِينَةِ فَلَمَّا أَذْلَقَتْهُ الْحِجَارَةُ هَرَبَ حَتَّى أَدْرَكْنَاهُ بِالْحَرَّةِ فرجمناه حَتَّى مَاتَ وَفِي رِوَايَةٍ لِلْبُخَارِيِّ: عَنْ جَابِرٍ بَعْدَ قَوْلِهِ: قَالَ: نَعَمْ فَأَمَرَ بِهِ فَرُجِمَ بِالْمُصَلَّى فَلَمَّا أَذْلَقَتْهُ الْحِجَارَةُ فَرَّ فَأُدْرِكَ فَرُجِمَ حَتَّى مَاتَ. فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خيرا وَصلى عَلَيْهِ

Ibn ‘Abbas said that when Ma'iz b. Malik came to the Prophet (ﷺ) and he* said, “Perhaps you kissed, or squeezed, or looked,” he replied, “No, Messenger of God.” He then said, “Did you have intercourse with her?” asking the question in plain words, and when he replied that he had, he gave orders that he should be stoned to death. Bukhari transmitted it. * i.e. the Prophet. The tradition leaves it to be inferred that Ma'iz had confessed to committing fornication.

وَعَنِ ابْنِ عَبَّاسٍ قَالَ: لَمَّا أَتَى مَاعِزُ بن مَالك النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ لَهُ: «لَعَلَّكَ قَبَّلْتَ أَوْ غَمَزْتَ أَوْ نَظَرْتَ؟» قَالَ: لَا يَا رَسُولَ اللَّهِ قَالَ: «أَنِكْتَهَا؟» لَا يُكَنِّي قَالَ: نَعَمْ فَعِنْدَ ذَلِكَ أَمر رجمه. رَوَاهُ البُخَارِيّ

Buraida told that Ma'iz b. Malik came to the Prophet (ﷺ) and said, “Purify me, Messenger of God.” He replied, “Out upon you! Go back, ask God's forgiveness and turn to Him in repentance.” He said that he went back not very far, then came and said, “Purify me, Messenger of God,” and the Prophet (ﷺ) said the same as he had said before. When this went on till a fourth time he asked, “For what am I to purify you?” and he replied that it was because of fornication. God’s Messenger then asked if the man was mad, and when he was told that he was not, he asked if he had drunk wine. A man got up and smelt his breath but noticed no smell of wine, so the Prophet (ﷺ) asked him if he had committed fornication, and when he replied that he had, he gave orders regarding him and he was stoned to death. Two or three days later God’s Messenger came and said, “Ask forgiveness for Ma'iz b. Malik. He has repented to such an extent that if it were divided among a people it would be enough for them all.” Then a woman of Ghamid, a branch of Azd came to him and said, “Purify me, Messenger of God.” He replied, “Out upon you! Go back, ask God’s forgiveness and turn to Him in repentance.” She said, “Do you want to send me back as you did to Ma'iz b. Malik when I am 1 pregnant as a result of fornication?” He asked whether she was referring to herself, and when she replied that she was, he told her to wait till she had given birth to what was in her womb. One of the Ansar became responsible for her till she was delivered of a child, and then went to the Prophet (ﷺ) and told him that the woman of Ghamid had given birth to a child. He said, "In that case we shall not stone her and so leave her child as an infant with no one to suckle him.” One of the Ansar then got up and said, "I shall be responsible for his suckling, Prophet of God." He then had her stoned to death. A version says that he told her to go away till she gave birth to a child, then when she did, he told her to go away and suckle him till she had weaned him. When she had weaned him she brought the boy to him with a piece of bread in his hand and said, "I have weaned this one and he has eaten food." He (hen handed the boy over to one of the Muslims, and when he had given command regarding her and she was put in a hole up to her breast, he ordered the people to stone her. Khalid b. al-Walid came forward with a stone which he threw at her head, and when the blood spurted on his face he cursed her, but the Prophet (ﷺ) said, "Gently, Khalid, By Him in whose hand my soul is, she has repented to such an extent that if one who wrongfully takes an extra tax 2 were to repent to a like extent he would be forgiven." Then giving command regarding her, he prayed over her and she was buried. Muslim transmitted it. 1. The Arabic uses the third person, saying she was pregnant. It may be an explanatory phrase, but I have ventured to treat it as part of the woman's word since this makes the sentence read a little more easily. 2. Sahib maks. Maks was money taken from sellers in the market in pre-Islamic times; it is also used of something taken by a tax-collector over and above that is duo.

وَعَنْ بُرَيْدَةَ قَالَ: جَاءَ مَاعِزُ بْنُ مَالِكٍ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: يَا رَسُولَ اللَّهِ طَهِّرْنِي فَقَالَ: «وَيْحَكَ ارْجِعْ فَاسْتَغْفر الله وَتب إِلَيْهِ» . فَقَالَ: فَرَجَعَ غَيْرَ بَعِيدٍ ثُمَّ جَاءَ فَقَالَ: يَا رَسُولَ اللَّهِ طَهِّرْنِي. فَقَالَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِثْلَ ذَلِكَ حَتَّى إِذَا كَانَتِ الرَّابِعَة قَالَه لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «فِيمَ أُطَهِّرُكَ؟» قَالَ: مِنَ الزِّنَا قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «أَبِهِ جُنُونٌ؟» فَأُخْبِرَ أَنَّهُ لَيْسَ بِمَجْنُونٍ فَقَالَ: «أَشَرِبَ خَمْرًا؟» فَقَامَ رَجُلٌ فَاسْتَنْكَهَهُ فَلَمْ يَجِدْ مِنْهُ رِيحَ خَمْرٍ فَقَالَ: «أَزَنَيْتَ؟» قَالَ: نَعَمْ فَأَمَرَ بِهِ فَرُجِمَ فَلَبِثُوا يَوْمَيْنِ أَوْ ثَلَاثَةً ثُمَّ جَاءَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «اسْتَغْفِرُوا لِمَاعِزِ بْنِ مَالِكٍ لَقَدْ تَابَ تَوْبَةً لَوْ قُسِّمَتْ بَيْنَ أُمَّةٍ لَوَسِعَتْهُمْ» ثُمَّ جَاءَتْهُ امْرَأَةٌ مِنْ غَامِدٍ مِنَ الْأَزْدِ فَقَالَتْ: يَا رَسُولَ اللَّهِ طَهِّرْنِي فَقَالَ: «وَيَحَكِ ارْجِعِي فَاسْتَغْفِرِي اللَّهَ وَتُوبِي إِلَيْهِ» فَقَالَتْ: تُرِيدُ أَنْ تَرْدُدَنِي كَمَا رَدَدْتَ مَاعِزَ بْنَ مَالِكٍ: إِنَّهَا حُبْلَى مِنَ الزِّنَا فَقَالَ: «أَنْتِ؟» قَالَتْ: نَعَمْ قَالَ لَهَا: «حَتَّى تَضَعِي مَا فِي بَطْنِكِ» قَالَ: فكَفَلَها رَجُلٌ مِنَ الْأَنْصَارِ حَتَّى وَضَعَتْ فَأَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: قَدْ وَضَعَتِ الغامديَّةُ فَقَالَ: «إِذاً لَا نرجُمها وندعُ وَلَدَهَا صَغِيرًا لَيْسَ لَهُ مَنْ يُرْضِعُهُ» فَقَامَ رَجُلٌ مِنَ الْأَنْصَارِ فَقَالَ: إِلَيَّ رَضَاعُهُ يَا نَبِيَّ اللَّهِ قَالَ: فَرَجَمَهَا. وَفِي رِوَايَةٍ: أَنَّهُ قَالَ لَهَا: «اذْهَبِي حَتَّى تَلِدِي» فَلَمَّا وَلَدَتْ قَالَ: «اذْهَبِي فَأَرْضِعِيهِ حَتَّى تَفْطِمِيهِ» فَلَمَّا فَطَمَتْهُ أَتَتْهُ بِالصَّبِيِّ فِي يَدِهِ كِسْرَةُ خُبْزٍ فَقَالَتْ: هَذَا يَا نَبِيَّ اللَّهِ قَدْ فَطَمْتُهُ وَقَدْ أَكَلَ الطَّعَامَ فَدَفَعَ الصَّبِيَّ إِلَى رَجُلٍ مِنَ الْمُسْلِمِينَ ثُمَّ أَمَرَ بِهَا فَحُفِرَ لَهَا إِلَى صَدْرِهَا وَأَمَرَ النَّاسَ فَرَجَمُوهَا فَيُقْبِلُ خَالِدُ بْنُ الْوَلِيدِ بِحَجْرٍ فَرَمَى رَأْسَهَا فَتَنَضَّحَ الدَّمُ عَلَى وَجْهِ خَالِدٍ فَسَبَّهَا فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسلم: «مهلا يَا خَالِد فو الَّذِي نَفْسِي بِيَدِهِ لَقَدْ تَابَتْ تَوْبَةً لَوْ تَابَهَا صَاحِبُ مَكْسٍ لَغُفِرَ لَهُ» ثُمَّ أَمَرَ بِهَا فصلى عَلَيْهَا ودفنت. رَوَاهُ مُسلم

Mishkat al-Masabih 3563

Aba Huraira told that he heard the Prophet (ﷺ) say, "When the slave woman of any of you commits fornication and the matter is clear, he should give her the appropriate beating, but not hurl reproaches at her. If she does it again he should give her the appropriate beating, but not hurl reproaches at her. If she does it a third time and the matter is clear he should sell her, even if only for a rope of hair." (Bukhari and Muslim)

وَعَنْ أَبِي هُرَيْرَةَ قَالَ: سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: «إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا الحدَّ وَلَا يُثَرِّبْ عَلَيْهَا ثمَّ إِنْ زنَتْ فلْيجلدْها الحدَّ وَلَا يُثَرِّبْ ثُمَّ إِنْ زَنَتِ الثَّالِثَةَ فَتَبَيَّنَ زِنَاهَا فَلْيَبِعْهَا ولوْ بحبْلٍ منْ شعرٍ»

Ali said

You people must carry out the punishment on your slaves, those of them who are married and those who are not, for a slave woman belonging to God’s Messenger committed fornication and he ordered me to beat her. But she had recently given birth to a child and I was afraid that if I beat her I might kill her, so I mentioned that to the Prophet (ﷺ) and he said, “You have done well." Muslim transmitted it. In a version by Abd Dawud he said, “Leave her till her blood stops flowing and then carry out the punishment on her, and carry out* the punishment on your female slaves”. Abu Dawud. *Here the verb is plural.

وَعَنْ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ قَالَ: يَا أَيُّهَا النَّاسُ أَقِيمُوا عَلَى أَرِقَّائِكُمُ الْحَدَّ مَنْ أُحْصِنَ مِنْهُمْ وَمَنْ لَمْ يُحْصَنْ فَإِنَّ أَمَةً لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ زَنَتْ فَأَمَرَنِي أَنْ أَجْلِدَهَا فَإِذَا هِيَ حَدِيثُ عَهْدٍ بِنِفَاسٍ فَخَشِيتُ إِنْ أَنَا جَلَدْتُهَا أَنْ أَقْتُلَهَا فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «أَحْسَنْتَ» . رَوَاهُ مُسْلِمٌ. وَفِي رِوَايَةِ أَبِي دَاوُدَ: قَالَ: «دَعْهَا حَتَّى يَنْقَطِعَ دَمُهَا ثُمَّ أَقِمْ عَلَيْهَا الْحَدَّ وَأَقِيمُوا الْحُدُودَ عَلَى مَا مَلَكَتْ أَيْمَانكُم»

Mishkat al-Masabih 3565

Abu Huraira told that when Ma'iz al-Aslami came to God’s Messenger and said he had committed fornication he turned away from him. He then came round to the other side and said he had committed fornication, but he turned away from him. He came round again saying he had committed fornication, and when he said it a fourth time God’s Messenger gave command regarding him and he was taken out to the harra and stoned. When he felt the effect of the stones he ran away vigorously till he passed a man who had the jawbone of a camel with which he struck him, and the people struck him till he died. They then mentioned to God’s Messenger that he had fled when he felt the effect of the stones and the touch of death, and he said, “Why did you not leave him alone?” A version has, “Why did you not leave him alone? Perhaps he might have repented and been forgiven by God.” Tirmidhi and Ibn Majah transmitted it.

عَنْ أَبِي هُرَيْرَةَ قَالَ: جَاءَ مَاعِزٌ الْأَسْلَمِيُّ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: إِنَّه قدْ زَنى فأعرضَ عَنهُ ثمَّ جَاءَ مِنْ شِقِّهِ الْآخَرِ فَقَالَ: إِنَّهُ قَدْ زنى فَأَعْرض عَنهُ ثمَّ جَاءَ من شقَّه الْآخَرِ فَقَالَ: يَا رَسُولَ اللَّهِ إِنَّهُ قَدْ زَنى فَأَمَرَ بِهِ فِي الرَّابِعَةِ فَأُخْرِجَ إِلَى الْحَرَّةِ فَرُجِمَ بِالْحِجَارَةِ فَلَمَّا وَجَدَ مَسَّ الْحِجَارَةِ فَرَّ يَشْتَدُّ حَتَّى مَرَّ بِرَجُلٍ مَعَهُ لَحْيُ جَمَلٍ فَضَرَبَهُ بِهِ وَضَرَبَهُ النَّاسُ حَتَّى مَاتَ. فَذَكَرُوا ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنه فرحين وَجَدَ مَسَّ الْحِجَارَةِ وَمَسَّ الْمَوْتِ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «هَلَّا تَرَكْتُمُوهُ» . رَوَاهُ التِّرْمِذِيُّ وَابْنُ مَاجَهْ وَفِي رِوَايَةٍ: «هَلَّا تَرَكْتُمُوهُ لَعَلَّه أَن يَتُوب الله عَلَيْهِ»

Ibn ‘Abbas told that the Prophet (ﷺ) asked Ma'iz b. Malik, “Is what I have heard about you true?” He asked what he had heard about him, and he replied that he had heard he had had intercourse with a girl belonging to the family of so and so. When he admitted it, and had acknowledged it four times, he ordered him to be stoned to death. Muslim transmitted it. (Here a tradition by Muslim has been placed in Section II.)

وَعَنِ ابْنِ عَبَّاسٍ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ لِمَاعِزِ بْنِ مَالِكٍ: «أَحَقٌّ مَا بَلَغَنِي عَنْكَ؟» قَالَ: وَمَا بَلَغَكَ عَنِّي؟ قَالَ: «بَلَغَنِي أَنَّكَ قَدْ وَقَعْتَ عَلَى جَارِيَةِ آلِ فُلَانٍ» قَالَ: نَعَمْ فَشَهِدَ أَرْبَعَ شَهَادَاتٍ فَأمر بهِ فرجم. رَوَاهُ مُسلم

Yazid b. Nu'aim, on his father’s authority, told that Ma‘iz came to the Prophet (ﷺ) and confirmed the matter four times in his presence, so he ordered him to be stoned to death, but said to Hazzal, “If you had covered him with your garment it would have been better for you.” Ibn al-Munkadir said Hazzal had ordered Ma'iz to go to the Prophet and tell him. Abu Dawud transmitted it.

وَعَنْ يَزِيدَ بْنِ نُعَيْمٍ عَنْ أَبِيهِ أَنَّ مَاعِزًا أَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَقَرَّ عِنْدَهُ أَرْبَعَ مَرَّاتٍ فَأَمَرَ بِرَجْمِهِ وَقَالَ لِهَزَّالٍ: «لَوْ سَتَرْتَهُ بِثَوْبِكَ كَانَ خَيْرًا لَكَ» قَالَ ابْنُ الْمُنْكَدِرِ: إِنَّ هَزَّالًا أَمَرَ مَاعِزًا أَنْ يَأْتِيَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فيخبره. رَوَاهُ أَبُو دَاوُد

Mishkat al-Masabih 3568

‘Amr b. Shu'aib, on his father’s authority, told that his grandfather, ‘Abdallah b. ‘Amr b. al-‘As, reported God’s Messenger as saying, “Forgive the infliction of prescribed penalties among yourselves, for any prescribed penalty of which I hear must be carried out.” Abu Dawud and Nasa’i transmitted it.

وَعَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَبْدِ اللَّهِ بْنِ عَمْرٍو بْنِ الْعَاصِ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «تَعَافَوُا الْحُدُودَ فِيمَا بَيْنَكُمْ فَمَا بَلَغَنِي مِنْ حَدٍّ فَقَدْ وَجَبَ» . رَوَاهُ أَبُو دَاوُد وَالنَّسَائِيّ

‘A’isha reported the Prophet (ﷺ) as saying, “Forgive the people of good qualities their slips, but not faults to which prescribed penalties apply.” Abu Dawud transmitted it.

وَعَنْ عَائِشَةَ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «أقيلوا ذَوي الهيآت عثراتهم إِلَّا الْحُدُود» . رَوَاهُ أَبُو دَاوُد

Mishkat al-Masabih 3570

She reported God’s Messenger as saying, “Avert the infliction of prescribed penalties on Muslims as much as you can, and if there is any way out let a man go, for it is better for a leader to make a mistake in forgiving than to make a mistake in punishing.” Tirmidhi transmitted it, saying it has been transmitted from her without tracing it to the Prophet, and that is sounder.

وَعَنْهَا قَالَتْ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسلم: «ادرؤا الْحُدُودَ عَنِ الْمُسْلِمِينَ مَا اسْتَطَعْتُمْ فَإِنْ كَانَ لَهُ مَخْرَجٌ فَخَلُّوا سَبِيلَهُ فَإِنَّ الْإِمَامَ أَنْ يُخْطِئَ فِي الْعَفْوِ خَيْرٌ مِنْ أَنْ يُخْطِئَ فِي الْعُقُوبَةِ» . رَوَاهُ التِّرْمِذِيُّ وَقَالَ: قَدْ رُوِيَ عَنْهَا وَلم يرفع وَهُوَ أصح

Mishkat al-Masabih 3571

Wa’il b. Hujr said that when a woman was forced against her will in the time of God’s Messenger he averted the punishment from her but inflicted it on the one who had molested her. The transmitter did not mention that he appointed a dower to be paid her. Tirmidhi transmitted it.

وَعَنْ وَائِلِ بْنِ حُجْرٍ قَالَ: اسْتُكْرِهَتِ امْرَأَةٌ عَلَى عَهْدِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَدَرَأَ عَنْهَا الْحَدَّ وَأَقَامَهُ عَلَى الَّذِي أَصَابَهَا وَلَمْ يُذْكَرْ أَنَّهُ جَعَلَ لَهَا مَهْرًا. رَوَاهُ التِّرْمِذِيّ

He said that a woman went out in the time of the Prophet (ﷺ) to go to prayer, and a man who met her attacked her and got his desire of her. She shouted and he went off, and when a company of the Emigrants came by she said, “That man did such and such to me.” They seized the man and brought him to God’s Messenger who said to the woman, “Go away, for God has forgiven you,” but of the man who had had intercourse with her he said, “Stone him to death.” He also said, “He has repented to such an extent that if the people of Medina had repented similarly it would have been accepted from them.” Tirmidhi and Abu Dawud transmitted it.

وَعَنْهُ: أَنَّ امْرَأَةً خَرَجَتْ عَلَى عَهْدِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ تُرِيدُ الصَّلَاةَ فَتَلَقَّاهَا رَجُلٌ فَتَجَلَّلَهَا فَقَضَى حَاجَتَهُ مِنْهَا فَصَاحَتْ وَانْطَلَقَ وَمَرَّتْ عِصَابَةٌ مِنَ الْمُهَاجِرِينَ فَقَالَتْ: إِنَّ ذَلِكَ الرَّجُلَ فَعَلَ بِي كَذَا وَكَذَا فَأَخَذُوا الرَّجُلَ فَأَتَوْا بِهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ لَهَا: «اذْهَبِي فَقَدْ غَفَرَ اللَّهُ لَكِ» وَقَالَ لِلرَّجُلِ الَّذِي وَقَعَ عَلَيْهَا: «ارْجُمُوهُ» وَقَالَ: «لَقَدْ تَابَ تَوْبَةً لَوْ تَابَهَا أَهْلُ الْمَدِينَةِ لَقُبِلَ مِنْهُمْ» . رَوَاهُ التِّرْمِذِيُّ وَأَبُو دَاوُدَ

Mishkat al-Masabih 3573

Jabir said that a man committed fornication with a woman and the Prophet (ﷺ) gave command that he be given the appropriate beating, but on being told afterwards that the man was married he gave command that he should be stoned to death. Abu Dawud transmitted it.

وَعَنْ جَابِرٍ: أَنَّ رَجُلًا زَنَى بِامْرَأَةٍ فَأَمَرَ بِهِ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَجُلِدَ الْحَدَّ ثُمَّ أُخْبِرَ أَنَّهُ مُحْصَنٌ فَأَمَرَ بِهِ فرجم. رَوَاهُ أَبُو دَاوُد

Mishkat al-Masabih 3574

Sa'id b. Sa'd b. ‘Ubada told that Sa'd b. ‘Ubada brought the Prophet (ﷺ) a man deficient in build and sick, a member of the clan, who had been found in the act of having illicit intercourse with a slave woman of theirs. The Prophet (ﷺ) said, “Get for him a stalk of the raceme of a palm-tree with a hundred twigs and strike him once.” It is transmitted in Sharh as-sunna; and there is something similar in Ibn Majah’s version.

وَعَنْ سَعِيدِ بْنِ سَعْدِ بْنِ عُبَادَةَ أَنَّ سَعْدَ بْنَ عُبَادَةَ أَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِرَجُلٍ كَانَ فِي الْحَيِّ مُخْدَجٍ سقيم فَوجدَ على أمة من إمَائِهِمْ بخبث بِهَا فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «خُذُوا لَهُ عِثْكَالًا فِيهِ مِائَةُ شِمْرَاخٍ فَاضْرِبُوهُ ضَرْبَة» . رَوَاهُ فِي شَرْحِ السُّنَّةِ وَفِي رِوَايَةِ ابْنِ مَاجَه نَحوه

‘Ikrima reported on the authority of Ibn ‘Abbas that God’s Messenger said, “If you find anyone doing as Lot’s people did, kill the one who does it and the one to whom it is done.” Tirmidhi and Ibn Majah transmitted it.

وَعَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسلم: «من وَجَدْتُمُوهُ يَعْمَلُ عَمَلَ قَوْمِ لُوطٍ فَاقْتُلُوا الْفَاعِلَ وَالْمَفْعُول بِهِ» . رَوَاهُ التِّرْمِذِيّ وَابْن مَاجَه

Mishkat al-Masabih 3576

Ibn ‘Abbas reported God’s Messenger as saying, “If anyone has sexual intercourse with an animal, kill him and kill it along with him.” Ibn ‘Abbas was asked what offence could be attributed to the animal and replied, “I did not hear anything about that from God’s Messenger, but I think he disapproved of its flesh being eaten or of any use being made of it when such a thing had been done to it.” Tirmidhi, Abu Dawud and Ibn Majah transmitted it.

وَعَنِ ابْنِ عَبَّاسٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنْ أَتَى بَهِيمَةً فَاقْتُلُوهُ وَاقْتُلُوهَا مَعَهُ» . قِيلَ لِابْنِ عَبَّاسٍ: مَا شَأْنُ الْبَهِيمَةِ؟ قَالَ: مَا سَمِعْتُ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي ذَلِكَ شَيْئا وَلَكِن أره كَرِهَ أَنْ يُؤْكَلَ لَحْمُهَا أَوْ يُنْتَفَعَ بِهَا وَقَدْ فُعِلَ بِهَا ذَلِكَ. رَوَاهُ التِّرْمِذِيُّ وَأَبُو دَاوُد وَابْن مَاجَه

Jabir reported God’s Messenger as saying, “The thing I fear most for my people is what Lot’s people did.” Tirmidhi and Ibn Majah transmitted it.

عَنْ جَابِرٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «إِنَّ أَخْوَفَ مَا أَخَافُ عَلَى أُمَّتِي عَمَلُ قَوْمِ لُوطٍ» . رَوَاهُ التِّرْمِذِيُّ وَابْن مَاجَه

Ibn ‘Abbas told that a man of B. Bakr b. Laith came to the Prophet (ﷺ) and made a statement four times that he had committed fornication with a woman, so he had a hundred lashes administered to him. The man had not been married. He then asked him to produce proof again the woman, and she said, “I swear by God, Messenger of God, that he has lied.” Then he was given the prescribed number of lashes for falsehood. Abu Dawud transmitted it.

وَعَنِ ابْنِ عَبَّاسٍ: أَنَّ رَجُلًا مِنْ بَنِي بَكْرِ بْنِ لَيْثٍ أَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَقَرَّ أَنَّهُ زَنَى بِامْرَأَةٍ أَرْبَعَ مَرَّاتٍ فَجَلَدَهُ مِائَةً وَكَانَ بِكْرًا ثُمَّ سَأَلَهُ الْبَيِّنَةَ عَلَى الْمَرْأَةِ فَقَالَتْ: كَذَبَ وَاللَّهِ يَا رَسُولَ اللَّهِ فَجُلِدَ حَدَّ الْفِرْيَةِ. رَوَاهُ أَبُو دَاوُد

‘A’isha said

When my vindication came down (Al-Qur’an, 24:11 ff) the Prophet (ﷺ) mounted the pulpit and mentioned that. Then when he came down from the pulpit he ordered that the two men and the woman* should be given the prescribed beating. Abu Dawud transmitted it. *The men are said to have been Mistah b. Uthatha and Hassan b. Thabit, and the woman Hamna daughter of Jahsh. Ibn 'Abd al-Barr, Istiab. p. 285, says Mistah was beaten, but he does not commit himself on p. 127 about Hassan, or on p. 714 about Hamna.

وَعَنْ عَائِشَةَ قَالَتْ: لَمَّا نَزَلَ عُذْرِي قَامَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى الْمِنْبَرِ فَذَكَرَ ذَلِكَ فَلَمَّا نَزَلَ مِنَ الْمِنْبَرِ أَمَرَ بِالرَّجُلَيْنِ وَالْمَرْأَةِ فَضُرِبُوا حَدَّهُمْ. رَوَاهُ أَبُو دَاوُدَ

Mishkat al-Masabih 3580

Nafi' said he was informed by Safiya daughter of Abu ‘Ubaid that one of the Caliph’s slaves had intercourse with a girl who was among the fifth of the booty, forcing her to it against her will, and deflowered her. ‘Umar had him beaten but did not have her beaten because he had forced her against her will. Bukhari transmitted it.

عَنْ نَافِعٍ: أَنَّ صَفِيَّةَ بِنْتَ أَبِي عُبَيْدٍ أَخْبَرَتْهُ أَنَّ عَبْدًا مِنْ رَقِيقِ الْإِمَارَةِ وَقَعَ على وليدةٍ من الخُمسِ فاستَكرهَها حَتَّى افتضَّها فَجَلَدَهُ عُمَرُ وَلَمْ يَجْلِدْهَا مِنْ أَجْلِ أَنَّهُ استكرهها. رَوَاهُ البُخَارِيّ

Yazid b. Nu'aim b. Hazzal told on his father’s authority that Ma'iz b. Malik who was an orphan under his father's protection had intercourse with a slave girl belonging to the clan, so his father told him to go and inform God's Messenger what he had done, for he might perhaps ask forgiveness for him. His purpose in that was simply a hope that it might be a way of escape for him. He went to him and said, “Messenger of God, I have committed fornication, so inflict on me the punishment ordained by God.” He turned away from him, so he came back and said, “Messenger of God, I have committed fornication, so inflict on me the punishment ordained by God.” When he had said it four times God’s Messenger said, “You have said it four times. With whom did you commit it?” When he replied that it was with so and so he asked whether he had lain with her and he replied that he had. He asked whether his skin had been in contact with hers and he replied that it had. He then asked whether he had had intercourse with her and he replied that he had. He ordered him to be stoned to death and he was taken out to the harra, but when he felt the effect of the stones and could not bear it he went away quickly. But ‘Abdallah b. Unais encountered him when those who had been stoning him could not catch up on him, threw the bone of a camel’s foreleg at him, hit him and killed him. Then when he went to the Prophet (ﷺ) and mentioned that to him he said, “Why did you not leave him alone,* for perhaps he might have repented and been forgiven by God.” Abu Dawud transmitted it. *The verb is in the plural.

وَعَنْ يَزِيدَ بْنِ نُعَيْمِ بْنِ هَزَّالٍ عَنْ أَبِيهِ قَالَ: كَانَ مَاعِزُ بْنُ مَالِكٍ يَتِيمًا فِي حِجْرِ أَبِي فَأَصَابَ جَارِيَةً مِنَ الْحَيِّ فَقَالَ لَهُ أَبِي: ائْتِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَخْبَرَهُ بِمَا صَنَعْتَ لَعَلَّهُ يَسْتَغْفِرُ لَكَ وَإِنَّمَا يُرِيدُ بِذَلِكَ رَجَاءَ أَنْ يَكُونَ لَهُ مَخْرَجًا فَآتَاهُ فَقَالَ: يَا رَسُولَ اللَّهِ إِني زنيتُ فأقِمْ عليَّ كتابَ اللَّهِ حَتَّى قَالَهَا أَرْبَعَ مَرَّاتٍ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: إِنَّكَ قَدْ قُلْتَهَا أَرْبَعَ مَرَّاتٍ فَبِمَنْ؟ " قَالَ: بِفُلَانَةَ. قَالَ: «هَلْ ضَاجَعْتَهَا؟» قَالَ: نَعَمْ قَالَ: «هَلْ بَاشَرْتَهَا؟» قَالَ: نَعَمْ قَالَ: «هَلْ جَامَعْتَهَا؟» قَالَ: نَعَمْ قَالَ: فَأَمَرَ بِهِ أَنْ يُرْجَمَ فَأُخْرِجُ بِهِ إِلَى الْحَرَّةِ فَلَمَّا رُجِمَ فَوَجَدَ مَسَّ الْحِجَارَةِ فَجَزِعَ فَخَرَجَ يَشْتَدُّ فَلَقِيَهُ عَبْدُ اللَّهِ بْنُ أُنَيْسٍ وَقَدْ عَجَزَ أَصْحَابُهُ فَنَزَعَ لَهُ بِوَظِيفِ بَعِيرٍ فَرَمَاهُ بِهِ فَقَتَلَهُ ثُمَّ أَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ: «هَلَّا تَرَكْتُمُوهُ لَعَلَّهُ أَنْ يَتُوبَ. فَيَتُوبَ اللَّهُ عَلَيْهِ» . رَوَاهُ أَبُو دَاوُد

‘Amr b. al-'As told that he heard God's Messenger say, “Fornication will not appear among any people without their being punished by famine, and bribery will not appear among any people without their being punished by terror.” Ahmad transmitted it.

وَعَنْ عَمْرِو بْنِ الْعَاصِ قَالَ: سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: «مَا مِنْ قَوْمٍ يَظْهَرُ فِيهِمُ الزِّنَا إِلَّا أُخِذُوا بِالسَّنَةِ وَمَا مِنْ قَوْمٍ يَظْهَرُ فِيهِمُ الرِّشَا إِلَّا أخذُوا بِالرُّعْبِ» . رَوَاهُ أَحْمد

Mishkat al-Masabih 3583, 3584

Ibn ‘Abbas and Abu Huraira reported God’s Messenger as saying, “Accursed is he who does what Lot's people did." In a version by him on the authority of Ibn ‘Abbas it says that ‘Ali had the two people concerned burned and that Abu Bakr had a wall thrown down on them. Razin transmitted it.

وَعَنِ ابْنِ عَبَّاسٍ وَأَبِي هُرَيْرَةَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «مَلْعُونٌ مَنْ عَمِلَ عَمَلَ قَوْمِ لُوطٍ» . رَوَاهُ رَزِينٌ وَفِي رِوَايَةٍ لَهُ عَنِ ابْنِ عَبَّاسٍ: أَنَّ عليَّاً رَضِي الله عَنهُ أحرَقَهما وَأَبا بكرٍ هدم عَلَيْهِمَا حَائِطا

[Ibn ‘Abbas] reported God’s Messenger as saying, “God who is great and glorious will not look at a man who has intercourse with a man or a woman through the anus." Tirmidhi transmitted it, saying; this is a hasan gharib tradition.

وَعَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لَا يَنْظُرُ اللَّهُ عَزَّ وَجَلَّ إِلَى رَجُلٍ أَتَى رَجُلًا أَوِ امْرَأَةً فِي دُبُرِهَا» . رَوَاهُ التِّرْمِذِيُّ وَقَالَ: هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ

He reported him as saying, “There is no prescribed punishment for one who has intercourse with an animal." Tirmidhi and Abu Dawud transmitted it. Tirmidhi quoted Sufyan ath-Thauri as saying that this is sounder than the first tradition, “Kill him who has intercourse with an animal," (Cf. p. 763) and that the learned act according to this one.

وَعَنْهُ أَنَّهُ قَالَ: «مَنْ أَتَى بَهِيمَةً فَلَا حَدَّ عَلَيْهِ» . رَوَاهُ التِّرْمِذِيُّ وَأَبُو دَاوُدَ وَقَالَ التِّرْمِذِيُّ: عَنْ سُفْيَانَ الثَّوْرِيِّ أَنَّهُ قَالَ: وَهَذَا أَصَحُّ مِنَ الْحَدِيثِ الْأَوَّلِ وَهُوَ: «مَنْ أَتَى بَهِيمَةً فَاقْتُلُوهُ» وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعلم

‘Ubada b. as-Samit reported God’s Messenger as saying, “Enforce God’s prescribed punishments on those who are near and those who are distant, and let no one’s blame come upon you regarding [the enforcement of] God’s [punishments]." Ibn Majah transmitted it.

وَعَنْ عُبَادَةَ بْنِ الصَّامِتِ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «أَقِيمُوا حُدُودَ اللَّهِ فِي الْقَرِيبِ وَالْبَعِيدِ وَلَا تَأْخُذْكُمْ فِي اللَّهِ لوْمةُ لائمٍ» . رَوَاهُ ابنُ مَاجَه

Ibn ‘Umar reported God’s Messenger as saying, “Enforcing one of God’s prescribed punishments is better than forty nights' rain in God’s land." Ibn Majah transmitted it, and Nasa’i transmitted it on the authority of Abu Huraira.

وَعَنِ ابْنِ عُمَرَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «إِقَامَةُ حَدٍّ مِنْ حُدُودِ اللَّهِ خَيْرٌ مِنْ مَطَرِ أَرْبَعِينَ لَيْلَةً فِي بلادِ الله» . رَوَاهُ ابْن مَاجَه وَرَوَاهُ النَّسَائِيُّ عَنْ أَبِي هُرَيْرَةَ

‘A’isha reported the Prophet (ﷺ) as saying, “A thief’s hand should be cut off only for a quarter of a dinar and upwards.” (Bukhari and Muslim).

عَنْ عَائِشَةَ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لَا تُقطعُ يدُ السَّارِقِ إِلاَّ بربُعِ دِينَار فَصَاعِدا»

Ibn ‘Umar said the Prophet (ﷺ) had a thief’s hand cut off for a shield worth three dirhams. (Bukhari and Muslim.)

وَعَنِ ابْنِ عُمَرَ قَالَ: قَطَعَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَدَ سَارِقٍ فِي مِجَنٍّ ثَمَنُهُ ثَلَاثَةُ دَرَاهِمَ

Abu Huraira reported the Prophet (ﷺ) as saying, “God curse a thief who steals an egg and has his hand cut off, and steals a rope and has his hand cut off!”* (Bukhari and Muslim.) *It has been suggested that baida (egg or steel helmet) should have the latter meaning and that a ship’s rope should be understood, but the translation above is usually accepted as the meaning.

وَعَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لَعَنَ اللَّهُ السارِقَ يسرقُ البيضةَ فتُقطعُ يَده وَيسْرق الْحَبل فتقطع يَده»
