Mishkat al-Masabih 363, 364

‘Umar said

The Prophet ﷺ me standing and passing water and said, "‘Umar, do not pass water standing." So I never did it again. Tirmidhi and Ibn Majah transmitted it. The shaikh and imam Muhyi as-Sunna has given a sound tradition from Hudhaifa who said that the Prophet (ﷺ) came to a midden and passed water standing. (Bukhari and Muslim.) It is said that that had a valid reason.

وَعَن عمر قَالَ: رَآنِي النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَأَنَا أَبُولُ قَائِمًا فَقَالَ: «يَا عُمَرُ لَا تَبُلْ قَائِمًا» فَمَا بُلْتُ قَائِمًا بَعْدُ. رَوَاهُ التِّرْمِذِيُّ وَابْنُ مَاجَهْ قَالَ الشَّيْخُ الْإِمَامُ مُحْيِي السّنة : قد صَحَّ: عَنْ حُذَيْفَةَ قَالَ: أَتَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سباطة قوم فَبَال قَائِما. . قيل: كَانَ ذَلِك لعذر

Abu Burda b. Niyar reported the Prophet (ﷺ) as saying, “No more than ten lashes are to be given, except in the case of one of the punishments prescribed by God.” (Bukhari and Muslim.)

عَن أبي بردة بن ينار عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لَا يُجْلَدُ فَوْقَ عَشْرِ جَلَدَاتٍ إِلَّا فِي حد من حُدُود الله»

Mishkat al-Masabih 3631

Abu Huraira reported the Prophet (ﷺ) as saying, “When one of you inflicts a beating he should avoid striking the face.” Abu Dawud transmitted it.

عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «إِذَا ضَرَبَ أَحَدُكُمْ فَلْيَتَّقِ الوجهَ» . رَوَاهُ أَبُو دَاوُد

Mishkat al-Masabih 3632

Ibn ‘Abbas reported the Prophet (ﷺ) as saying, “When a man calls another a Jew give him twenty lashes, when he calls someone a mukhannath* give him twenty lashes, and kill anyone who has intercourse with a woman who is within the prohibited degress.” Tirmidhi transmitted it, saying this is a gharib tradition. * Mukhannaths were sexually abnormal men who imitated women. Some of them were signets.

وَعَنِ ابْنِ عَبَّاسٍ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: " إِذَا قَالَ الرَّجُلُ لِلرَّجُلِ: يَا يَهُودِيُّ فَاضْرِبُوهُ عِشْرِينَ وَإِذَا قَالَ: يَا مُخَنَّثُ فَاضْرِبُوهُ عِشْرِينَ وَمَنْ وَقَعَ عَلَى ذَاتِ مَحْرَمٍ فَاقْتُلُوهُ ". رَوَاهُ التِّرْمِذِيُّ وَقَالَ: هَذَا حَدِيثٌ غَرِيب

Mishkat al-Masabih 3633

‘Umar reported God’s Messenger as saying, “When you find a man has been unfaithful about spoil in God’s path, burn his goods and beat him.” Tirmidhi and Abu Dawud transmitted it, Tirmidhi saying this is a gharib tradition.

وَعَنْ عُمَرَ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «إِذَا وَجَدْتُمُ الرَّجُلَ قَدْ غَلَّ فِي سَبِيلِ اللَّهِ فَاحْرُقُوا مَتَاعَهُ وَاضْرِبُوهُ» . رَوَاهُ التِّرْمِذِيُّ وَأَبُو دَاوُدَ وَقَالَ التِّرْمِذِيُّ: هَذَا حَدِيث غَرِيب هَذَا الْبَاب خَال من الْفَصْل الثَّالِث

Mishkat al-Masabih 3634

Abu Huraira reported God’s Messenger as saying, “Wine comes from these two trees, the date-palm and the grapevine.” Muslim transmitted it.

عَنْ أَبِي هُرَيْرَةَ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: " الْخَمْرُ مِنْ هَاتَيْنِ الشَّجرتينِ: النخلةِ والعِنَبَةِ ". رَوَاهُ مُسلم

Mishkat al-Masabih 3635

Ibn 'Umar told that ‘Umar gave an address on God’s Messenger’s pulpit, saying, “The prohibition of wine has come down (Al-Qur’an, 5

90) and it comes from five things: grapes, dates, wheat, barley and honey. Wine (khamr) is what infects (khamara) the mind.” Bukhari transmitted it.

وَعَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا قَالَ: خطَبَ عمرُ رَضِي الله عَنهُ عَلَى مِنْبَرَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: " إِنَّهُ قَدْ نَزَلَ تَحْرِيمُ الْخَمْرِ وَهِيَ مِنْ خَمْسَةِ أَشْيَاءَ: الْعِنَبِ وَالتَّمْرِ وَالْحِنْطَةِ والشعيرِ والعسلِ وَالْخمر مَا خامر الْعقل ". رَوَاهُ البُخَارِيّ

Mishkat al-Masabih 3636

Anas said

Wine was forbidden when it was forbidden (i.e. by the Qur’an), but we get only a little of the wine from grapes, most of our wine being from unripe dates and dry dates. Bukhari transmitted it.

وَعَنْ أَنَسٍ قَالَ: لَقَدْ حُرِّمَتِ الْخَمْرُ حِينَ حُرِّمَتْ وَمَا نَجِدُ خَمْرَ الْأَعْنَابِ إِلَّا قَلِيلًا وَعَامة خمرنا الْبُسْر وَالتَّمْر. رَوَاهُ البُخَارِيّ

'A’isha said that when God’s Messenger was asked about bit’, which is the nabidh* from honey, he replied, “Every liquor which intoxicates is forbidden.” (Bukhari and Muslim.) * Nabidh is a drink made from dates, raisins, honey, wheat, barley, etc. The ingredients were steeped in water in a vessel, and provided the drink was used before fermentation took place it was lawful.

وَعَنْ عَائِشَةَ قَالَتْ: سُئِلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنِ الْبِتْعِ وَهُوَ نَبِيذُ الْعَسَلِ فَقَالَ: «كُلُّ شَرَابٍ أَسْكَرَ فَهُوَ حَرَامٌ»

Ibn ‘Umar reported God’s Messenger as saying, “Every intoxicant is khamr and every intoxicant is forbidden. He who drinks wine in this world and dies when he is addicted to it, not having repented, will not drink it in the next.” Muslim transmitted it.

وَعَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «كُلُّ مُسْكِرٍ خَمْرٌ وَكُلُّ مُسْكِرٍ حَرَامٌ وَمَنْ شَرِبَ الْخَمْرَ فِي الدُّنْيَا فَمَاتَ وَهُوَ يُدْمِنُهَا لَمْ يَتُبْ لَمْ يَشْرَبْهَا فِي الْآخِرَةِ» . رَوَاهُ مُسلم

Mishkat al-Masabih 3639

Jabir told of a man who came from the Yemen and asked the Prophet (ﷺ) about a liquor made from millet called mizr which they drank in their country. The Prophet (ﷺ) asked whether it was intoxicating and when he replied that it was, he said, “Every intoxicant is prohibited. God has made a covenant regarding those who drink intoxicants to give them some tinat al-khabal to drink.” He was asked what that was and replied that it was the sweat of the inhabitants of hell, or the discharge of the inhabitants of hell. Muslim transmitted it.

وَعَنْ جَابِرٍ أَنَّ رَجُلًا قَدِمَ مِنَ الْيَمَنِ فَسَأَلَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ شَرَابٍ يَشْرَبُونَهُ بِأَرْضِهِمْ مِنَ الذُّرَةِ يُقَالُ لَهُ الْمِزْرُ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «أوَ مُسْكِرٌ هُوَ؟» قَالَ: نَعَمْ قَالَ: «كُلُّ مُسْكِرٍ حَرَامٌ إِنَّ عَلَى اللَّهِ عَهْدًا لِمَنْ يَشْرَبُ الْمُسْكِرَ أَنْ يَسْقِيَهُ مِنْ طِينَةِ الْخَبَالِ» . قَالُوا: يَا رَسُولَ اللَّهِ وَمَا طِينَةُ الْخَبَالِ؟ قَالَ: «عَرَقُ أَهْلِ النَّارِ أَوْ عُصَارَةُ أَهْلِ النَّارِ» . رَوَاهُ مُسلم
